Sex Crimes and HCV

It you were the victim of a sexual assault, and we're convinced this is how you got HCV.  Would you press charges and demand the person be tested to verify whether they had HCV.

I would ask for the person to be tested so that I'd know if I were the same Genotype.  Then I'd want some investigation done to find out if the person knew they had HCV.  If they knew and had violent sex with good chance of exchanging blood - damn right.....along with them already being charged for sexual assault, right?  

In Canada, there was a fellow convicted of murder AND declared a dangerous offender because he kept having unprotected sex with women without declaring he had HIV.  The sex was consenting. Two of the women later died of complications due to AIDS.  Yes, they put themselves at risk but he KNEW he was putting them at risk for HIV/AIDS and said nothing.

The question wasn't 'lifestyle', it was asault.
Gene sequencing would probably give a likely source of infection . An established blood donor or anyone else who had tested neg recently, could hopefully establish a time frame that would allow them to tx during acute phase.

If I was the victim of a sexual assuault I would definitely press charges. In addition, regardless of my lifestyle, if I was the victim of a sexual assault, that assault would in no way be partly my fault. In my opinion, the assault victim is never ar fault. An assault is always the fault of the assailant.

It would depend on the circumstances really.  Like if it was a man that was molesting a 12 hr girl, who was never sexually active and had no other risk factors for HCV, prior to it, heck yea, if I were her parents I'd use that as evidence to the cops, for added proof.  Something like that. However, if I was an adult and I had been running around having unprotected sex with numerous people and also using IV drugs and one of those people happened to come up positive for HCV and I subsequently took a test and found out I was positive, then, no, I would not press charges.  Because I would be partially at fault for living a risky lifestyle.  Sort of like, if you play with matches, you might get burnt sort of thing.  Susan400

Let's see:
What if you knew for certain you were infected by the US military with an airgun vaccine during boot camp. Would you press charges?
Would it do you any good?

I know I'm snarly this morning but the point is, I'm sure many, many more people were infected in this way, than in your imaginary assault.

You might research the postings of the member who posts as alagirl. She was a regular blood donor, her assault was documented, and her assailant was proven HCV +. Her story details what is involved in this type of case. She was always very open and forthright about her experience and has always had my deepest admiration for her honesty and for what she endured to pursue this type of case.

you wouldnt be able to prove it.    If somehow you could,  yes I would press charges for everything related to the crime

Can't answer that because I guess from personal experience I am  positive I got acute hcv from the medical profession last year but  can't PROVE it nor  could you really PROVE it came from the assault, I don't think anyway.  It is an interesting question though.
