there have been a number of cases in the media this past year with cases similar to what the Florida guy mentioned. but in terms of a Dr. not disclosing HCV status, I do not believe that is required by law. If memory serves me, there was a case of a physician who apparently infected someone or someone's he was operating on as he was HCV positive. There was no criminal prosecution I remember correctly as he was not required to disclose.
Forget the sexual transmitting (some debate) and the comparison of fatality to HIV. I was asking if an individual or institution was ever found liable of infection.
I was thinking about that the other day, wondering what is going on with the case. I hope the media doesn’t “sweep it under the rug.”
There is a case which broke about a year ago in Las Vegas. It was a 'scope center' (colon, endo etc) in which they re-used the implements used in the procedures. The results were that a bunch of people infected. Don't think the whole mess has been finally resolved and I'm not sure if is criminal or civil in nature (although I sure have my own opinion).
