Testimony Banned In Trial Of Woman Accused Of Microwaving Baby

DAYTON, Ohio - The state cannot present a jury with the results of experiments that used calf brains and chicken torsos in an effort to duplicate the injuries of a baby prosecutors say was killed by being cooked in a microwave oven, a judge ruled Tuesday.

The design of the test by New York consultant Robert Schiffman failed to reliably determine how long infant Paris Talley may have been exposed to microwave heating and would not aid a jury in reaching a decision in the murder trial of the girl's mother, visiting Judge John Kessler said in Montgomery County Common Pleas
Court.

Investigators believe China Arnold, 27, killed the one-month-old Talley by putting her in a microwave oven in August 2005.

Arnold is charged with aggravated murder and could face the death penalty if convicted. She has pleaded not guilty. Her trial is scheduled to begin Monday.

During the pretrial hearing, Schiffman said Talley had injuries consistent with being left in a microwave for at least two minutes, based on his experiments.

Defense attorneys had asked Kessler to exclude Schiffman's testimony.

Kessler said Schiffman is clearly an expert on the workings and characteristics of microwave ovens and would be permitted to render his opinion related to that.

He also ruled that two expert witnesses for the defense may testify as long as their testimony coincides with their areas of expertise.

George Nichols, a pathologist from Louisville, Ky., testifying for the defense, challenged claims that Talley was put in a microwave for at least two minutes, saying chickens are unreliable indicators because they have different body structures.

Defense witness Robert Belloto, a staff pharmacist at Good Samaritan Hospital, testified that he doesn't believe it would have been possible for Arnold to place the baby in the microwave because the woman was so intoxicated at the time.    

Belloto said Arnold told him she had consumed about 40 percent of a pint of high-proof rum in 90 minutes; however, he acknowledged that he had no other corroboration for her claim.
