Can my landlady kick me out for having a baby?

Yesterday morning I had a chat with my landlady who informed me that when the baby comes if she is making noise that I would have to leave. ... I have been renting from her for 6 years. ... Never had problems.  The rent is ridiculously expensive asb nd she is putting it up again as well. ... I think she just had something against babies. .. But can she actually say to me that I have to leave if my baby makes noise?

If she's making statements like that and raising your rent all the time... Why would you want to live there anyways???

I mean, I understand... Moving is a pain in the butt, deposit, ect... Buuuut... If I were you, I wouldn't give my money to someone like that to begin with. You have a long rent history with her. Not every landlord can say they've had a tenant who religiously paid rent for 6 years. If I were her, I'd be grateful to have you as a tenant.

Just my opinion. Good luck! =)

And yeah, if you have an eleven year old and that child has it's own bedroom, she may be trying to evict based on that fact/the one I stated about each child being required by law to have their own bedroom.  It has nothing to do with the fact that it's a baby.  She is required as the renter of the property or she can be fined.

She shouldn't be able to, no.  Not unless you're living in a one bedroom apartment or, like an above comment said, the lease has specifics about children.  If you are living in a one bedroom, then legally, she can evict you because there are laws in place that state there has to be at least one bedroom per child.  Some states also make it to where that if you have two children of opposite sexes, when they reach a certain age, they are not allowed to share a room.

IT CAN STATENO CHILDREN IN YOUR LEASE. IN SOME STATES IF THERE IS THE POSSIBILITY OF LEAD PAINT THEY CAM REFUSE CHILDREN. Also there are 65+ communities. Look up your States laws. In NH it takes a while to evict someone.  Some states you cannot evict people with children in winter months.  It varies mostly by state.

In the US that violates Fair Housing Laws... It falls under familial status which is a protected class.

They usually can't. You have renters rights. Especially if nothing is mentioned in the lease. But they don't have to renew your lease when your lease is over either. So maybe find somewhere else not as expensive and so your not stressed out when the lease is up.

It says nothing about children in the agreement.  And I have an 11 year old who had lived with me the whole time and never made any noise he was 6 when we moved in. I live in Devonport Auckland in New Zealand.  Am about to ring the Department of Building and Housing to find out more information.  I just think she had something against babies. ... I have been super nice to her over the years. ... Flowers. ... Christmas gifts. .. age lives up stairs.... and is all alone.  None of her kids come to see her at all. ... None of them.  I have felt sorry for her. .. Can't believe she would pull this back hander. ..

By law no one can refuse to rent to anyone based on age, race or religion. That would be the she part of that law, and is illegal in all 50 states and Canada.

That is housing discrimination and is punishable by law! Contact your housing authority

No as long as you are not causing deliberate noise. Such as fighting, loud music and the like... it kinda depends on what type of rental agreement you have, if you have a lease and it does not say no kids then she has no right to make you leave.

I've heard of people refusing to rent if you have a baby.. for some reason they think babies are like pets and make messes. Its so wrong.

Not unless it states no kids in the lease.
