Help

Ok I was wondering if I can give my son his fathers last name even if his father physically can't be there for his birth. He is in prison and gets out sometime in aug. We are not married either. Can anyone help me with this or know how the whole naming thing goes.

You can give your child whatever last name you want to give them.

You can give your child WHATEVER name you feel like giving him. It doesn't even have to be either one of your names if you that's what you were to choose. The only thing you can't do is sign any legal documents on your husband/boyfriends behalf. He would need to establish parentage for himself once he's out.

Emommy yes that why I said you can put his name as my friend did and when he gets out he can put his name as the father... sorry if it didn't make sense the first time... I try to condense so its not too long :-)

Actually I know three women from my dads unit that were unmarried and expecting while they were in Iraq 5 years ago... being deployed while your going to be a father does not mean that you have to be married just like having a baby in general doesn't mean your married.

Yes you can give the baby any name u want so you can give the baby the dads last name.  And ladies she wasn't asking about putting the father on the birth certificate just asking about naming the baby.

Thenewmrs_b... fathers who are deployed and in the military are most of the time married to their child's mother... when a woman is married it becomes a different scenario and the father does not have to be present

My friend actually had the same situation. In ma you can put his name but when he gets out he has to go to city hall in the city you gave birth in and officially sign it. Generally though a woman cones up with the paper work and walks you through it so you can always check with her for your state. I'm sure they are familiar with the dad not being present at birth especially with dads being deployed a lot for the past 10 yeads

Since you are not married... they will not alloe his name to be on the birth certificate unless he signs off on it... you should be able to give him his last name though
