child support/heart racing

Two part question:

So my husband filed for child support to have visitation and help his child. To my understanding after talking with our lawyer when his ex was served with papers she had 20 days to respond back to the courts. Now she's saying her lawyer filled out the paper work for her and he's sending it back to my husband and now he has 20 days to respond back.

It confuses me because our lawyer never  said she had to give the paper work back to us. Like I said i thought she was suppose to send it to the courts.

Has anybody filed for child support? Is this the process?

After my husband had this conversation with his ex I haven't been able to get my heart rate down.

Any suggestions on how to make my heart stop racing??

The Judge hopefully will look in see why he put himself on support and hopefully rule in his favor!!:-)

I don't know about the child support,  however for your question about your heart racing; it sounds like you are very anxious. Try to breath slowly, do something that relaxes you, maybe even meditate.  I hope this helps and I wish you and your husband tge best.

Every State is different on how they act upon Child Support. I'm here in Florida and when I put my son (who's 7 now) his dad on support it took 18- months because they lost our case in the system. I called twice a week to see about progress as well.

They have you do a DNA test and that (if you accept) takes the longest. When I put his dad on support I filed and filled out the packet and didn't have to pay anything. Well when my son was 2010-2011 he was remarried and she took me to court although only he showed. They took all the money that was given in the beginning in 2008 which at that time my son was 18 months old; in which his dad and I were back together.

Any ways when they took almost 76% of what my son was getting in support weekly was now a decrease. I was and am also responsible for his Health Insurance and the Judge who granted me the money took it away and at this time he was also paying support for another child. But because my son was older, he received less and it was given to his other child as well as credits.

Well, it's been 3 years and I was told the courts are suppose to take us back to court for changes. In which changes have gathered because his dad went from being $26 an hour, to unemployment to now he's making $40 an hour and to take himback to court although I filed and filled out another form. The courts want $100, $60 for the Court and $40 for the Sheriff. Yet, the funny thing is they only have a P.O.Box for him and they can't serve him. Because Idon't have his physical address; he won't be served.

It's a lot to handle, a lot of work and emotion to deal with Support. His dad has nothing to do with him what so ever since I left him back in 2010! It's sad but the truth.

I would fill out all that needs to be done, dispute what you feel is unreasonable but realistic. Make sure you name copies of everything. Any money that he gives, to have receipts just in case.

@alxg I'm more relaxed. Your right at least he will get to have visitation but I have to be patient.

Good luck hun. I've been thru and it is hard. I'm dealing with my ex husband and his 23 yr old wife. Just pray and he is trying to do the right thing unlike most dads.

@ bholcomb She has the child. And we put ourselves on child support to have visitation rights and to help them. We want to do everything legal because she's always back and forth (depending on her mood) about him seeing his son. It was the best route to go.

Thank you bump2015. Your right its out of my hands. I have to let my husband deal with these things. Its putting way to much stress on me. I know it affects the baby because he would not stop moving. It just stresses me out because we been dealing with this child support issue for a year now.

Just breath and relax... it's overwhelming but it's gonna be OK.....If you're in California he will get visitation rights if he shows the courts that he wants to be in the childs life and he's fit for it... You'll go to court and maybe mediation.. they will then decide.. But because he took aniciative, it looks great on his part.. It will take some time so be patient..

In the state of Arkansas if a parent goes a yr without any contract then he has no rights.

Who has the child? I know from my ex ours went thru court we didn't do anything. If you have a lawyer he/she should have done the papers.

@ rockrose Yes he put himself on child support to get visitation. Plus we figured its best because it will help her and his child.

Is your husband trying to pay child support,  and in doing that,  get visitation with his child?

Worst case scenario, she could be filing  a counter suit. But I really have no idea how that process works.

Just try to breathe and relax. It's our of your hands. Try a long hot shower or bath (maybe even with hubby). Or some tea and a girly, tearjerker movie..
