Yea i got married in mexico signed everything there i have not got married here in the states at all
They told me the only other way to do it if my husband didn't come sign was to get the papers we had already well started into the divorce saying I was pregnant and it wasn't his but that wouldn't work in your case
From what I understand you can give him the father's last name without any problem. The only problem that could happen is if you husband tried to start trouble. But you could easily get a DNA test to show that the man who isn't your husband is the father. Also I would talk to a later about your marriage, did you get married in the US as well. Because technically you might be married in mexico but not in the US. But I don't know much about that, and if that's the case your husband technically has no rights in your life right now anyway.
I had a similar issue where I wasn't technically divorced yet when I got pregnant, at the hospital they told me my husband would have to come sign papers before we could leave saying he knew it wasn't his baby so my son could take my boyfriends last name! My guess is you could get papers early to send yout husband to send back before your baby is born so you don't have to worry about it after your baby arrives

Without dna your husband would have to go sign papers saying he knows it's not his child so your child can have your boyfriends last name!
Definitely talk to a lawyer but you can give the baby any name you want.
The thing is hes in mexico thats where we got married he choose not to come back becuz our only child we have together was born with a birth defect and he said he didnt want a sick kid but i will def talk to a lawyer and thanks alot becuz i feel i shouldhave had my divorce along time ago but he said i had to pay for it
You need. To talk to a lawyer technically your husband could cause issues if he wanted to until DNA was prove otherwise.
