Well, in California it's statutory rape to have sex with someone under 18, if the partner is 3 years older and they aren't married.
And he is 3 years older.
It seems unlikely any charges would come of it, as for some reason this law is used very randomly - and what some men get away with, others have to bear the stigma of sex offender for the rest of their lives.

Don't really see why putting his last name would be an issue. Baby's name will be whatever you put down for the birth certificate.
