Needing to vent about my SIL

ok my SIL is 20 years old and fixing to have her 4th baby any day...no big deal congrats to her....well the thing is she had her first at 15 and then 3 months later got pregnant with her second.....no biggie still well after a year or so I guess she got bored with them.....(after her hubby got put in prison)  so she dropped them off with his mom and just never seemed to come get them....she'd visit but that's it......ok still at least they are being taken care of.....well 2 years ago with my brother still in prison she got pregnant again (by his best Friend).....ok well she kept this baby and still has her......well ok then she got pregnant again and is due any day well right after she got pregnant this time by the same guy he then gets put in prison.....he just got out last week and they are staying with my mom......her husband's Step mom.....ok still no biggie they are just staying til they find something else.....well yesterday they informed me they  got a place and come to find out it's right by me but the problem is if you all remember a few months back we got flooded 2x well this appt they are moving in is disgusting and not to meantion it was under water so you know what that means......walls are infested with mold and mildew....but the problem is they already payed the rent and deposit......and the guy never meantioned to them it was flooded......shouldn't he be required by law to tell them?   Well i'm just so upset cause even though she's not a mom to her first two little girls at least they are trying to be parents to these two but I just can't imagine them considering just moving into something like this.....so of course I insisted they try to get their money back and stay with us til they get a place but I really don't have the room and I'm so stressed what it they are still there when my babies come......and I know I'll be raising her babies pretty much since I mostly raised her first baby for the first year..........

Great new the guy gave them their money back I'm so happy I was really worried about moving them babies in those kind of conditions

General obligations of landlords

Landlords should:

    * Make property habitable before tenants move in.
    * Make and pay for repairs due to ordinary wear and tear.
    * Refrain from turning off a tenant's water, electricity or gas.
    * Provide written notice to tenants when ownership of the property is transferred to a new landlord.
    * Not unlawfully discriminate.

1997 Landlord-Tenant law provisions: Laws approved in 1997 offer greater protection for tenants renting from unresponsive landlords...

Chapters 441, 534 and 535 in the Missouri Revised Statutes address landlord-tenant issues.

Since they seem like they are stuck with the situation, like it or not, they should probably still plan on moving in with ONE provision to their rental agreement if it is already not stated in writing.

The agreement should state which repairs are the landlord's responsibility and which are the tenant's.

The landlord should be responsible for repairs caused by ordinary wear and tear and NATURAL FORCES SUCH AS WEATHER. Tenants should pay for damages resulting from their own negligence or the negligence of a guest.  Once this is signed, your SIL will be in good hands with MO law.

If repairs are needed, which you believe to be the case, she can ask the landlord to make repairs within a reasonable period of time. If repairs are not made, make a written request for the necessary repairs and keep a copy of the letter.  IF SHE DOESN'T KNOW/UNDERSTAND THE EXTENT TO WHICH REPAIRS NEED TO BE MADE, SHE CAN CALL THE LOCAL BOARD OF HEALTH OR CITY INSPECTOR'S OFFICE AND ASK THEM TO CHECK IT OUT TO ENSURE IT IS SAFE/HABITABLE.

If the repairs still are not made, UNDER MO LAW, the tenant may seek legal assistance. If the dwelling becomes unsafe due to the repair problems, the tenant should contact local health or housing authorities.  They can and will send letters to the owner saying they will condemn the property and have the actual right to take the property and not give it back if changes are not made in time (at least in MA they can take it...not sure about MO...)

It is not wise to withhold rent payments until repairs are completed because the renter may be in violation of the lease/rental agreement and may be subject to eviction...which is not what you or she wants!

Under very limited circumstances, under MO law, the tenant may make repairs and deduct the cost from rent if the tenant:

    * Has lived on the property for at least six months.
    * Has paid all rent owed.
    * Is not in violation of the lease.
    * HAS NOTIFIED THE LANDLORED OF THE PROBLEM AND HAS ALLOWED AT LEAST 14 DAYS FOR THE LANDLORD TO RESPOND.
    * Has, at the landlord's request, received verification from city inspectors that the problem violates city code.  

If the landlord still does not fix the code violation within 14 days of receiving the city's notice, then the tenant can proceed with the repairs.

The amount of the repair must be verified by receipts. In most cases, the cost of repair must be less than $300 or one-half month's rent (whichever is greater), and can be done once a year.

CAUTION: IF YOUR SIL PAYS FOR ANYTHING, SHE MIGHT HAVE TO GO TO COURT TO GET PAID BACK...IF THIS LANDLORD IS SHADY ENOUGH TO RENT OUT A PLACE LIKE THIS THAN HE MIGHT NOT BE THE KIND OF PERSON WHO PAYS PEOPLE BACK AND YOUR SIL CAN'T STOP PAYING RENT SO HE IS GETTING HER MONEY AND SHE KNOWS HE HAS MONEY, AND HE CAN TRY TO STIFF HER...THIS COULD BE A ROCKY ROAD!

The one thing i am confused about is---is your brother still in jail? is he ok with his bf and his wife being together? are they still married?

yeah I'm sucker for babies and always have so I am sure here in a week I'l have a newborn to pretty much take care of....they are inducing her June 16th......I just hope I can still get things ready for my babies next month

thats a hard choice u have to make. i dont know if there is a law about apartment situations. they would have to  go  to court and fight for the money  if the landord dont give it back. my sister's baby is comin home soon from the hospital, he was born premature and the landlord gave them notice, she dont have anywhere to put him as of yet. they have to look for new money for rent and security again. they were renting a room from her man's aunt. i told her bring him over here and leavin him. i'll take care of him for u. i hate to see children sufferin. as long as i shall live, i will never see a child in need ande dont help.my sister is in a crazy situation.
