So anyobe who follows me knows I have an annoying roommate who the fiance and I have been trying to kick out. Well, last week I was so stressed out and not sleeping, my mom decided she was going to fly me home (my fiance is a Navy Corpsman, we live in Tx and my family lives in,MO) I was so excited to come home fo a while. my trip is 20 days long. Well little did I know my roommate was Juss going to make my while vacation even more hell.. The first day I was gone (this last Wednesday) she left her dough in our apartment and it destroyed it. Now mind you, she is not on our lease and we have no pet deposit paid. She's been told numerous times, no dog! She listens so well. My fiance is not the type of person to confront ppl, so he called me, he had just gotten of a 3am,

shes  hitting on as in trying to sleep with him, not abusing him. They are both military and if she was doing that its retaliation, he wuld not pass that by.

and she doesnt get mail or anything at the apartment, she juss stays there, apparently for free now.

While we were fetting along with the roommate we were in the process of switching to a 2bd 2 bth, cuz we have 1 bth right now, so they knew someone else was going to be living with us, and I know I can call the police in her, I lived with my ex for 3 yrs n when he kicked me out he called the cops n they made me take all my stuff out BC his mother owned the house. Soo I know I can, but my hubby is a,push over and im not there to put her things out. What I decided was that im calling the leasing office in the morning and having them switch our lease to a 1bd, they told us in the beginning when we move out, nething left once we turn our keys in they get rid of and sell, so I told her to get her thinga out by tomorrow, and she has completely avoided the apartment. I told my fuance not to tell her wgen we are moving, and if her stuff is still there then tuff

You need to look at your states laws. Every state is diff. Here you can not just lock someone out if they get mail and all that there. Just call your local housing department and they will tell you what to do.

I noticed u r in tx.  Texas law states you must give them a written notice to vacate and you must post it on their door. If they do not leave by the sate u privide then you have to file formal eviction papers which is approximately $72.00.  Also since they are not on the lease you are considered their landlord and without being on the lease they are considered your month to month tenant.  If you don't do it the legal way be prepared because they can sue you for illegal eviction and be awarded damages. Now if the person is doing something criminal have them arrested or file a report, it will help your case. Good luck.

Check again, when you invite a roommate in whether they are on the lease or not it becomes a landlord/tenant relationship because you are essentially subleasing the property to them.  And when you throw their property out you become liable for that as well. Also some states have what is called squatters rights.

I would call  the police and have them escort HER and her things out of your apartment. If shes not on the lease then she doesnt have a right to be there if you dont want her there. You are pregnant and dont need this kind of stress.

I've been in this situation as well and I know how angry it made me. I live in Texas as well and what I had to do since my ex roomate wasn't on the lease like trying43 said its illegal tto kick them out since they have indeed established a residency wad I called the non emergency for the police and had them come by my  apartment and do a standby while she removed all her things. now that is one thing you are aloud to do with out having to go through the court to get her legally evicted. so try that and see if that works. cause te officer gives them a time limit and if they don't get everything out the first time they can't come back in to get it on a later date and it basically your property.

I wouldn't put her stuff out because if she's already playing that dirty then next thing u know she's gonna say u guys stole something or that something got stolen because it was out. Get the police and have them meet u and her there when u know you'll both be home and I'm sure they will gladly escort her off the property

If she's hitting your guy he needs to call the cops have her arrested,get a restraining order an pack her crap up for her parents to get. Plan b force her out have your guy stay at a friends for a few days an cut the lights, whats she gonna do live off candles lol just joking..or am i..lol. call the cops she cant touch him point blank.

It's not illegal to throw someone out of they were never on the lease...that's not eviction, because it was never her home. Tell your landlord if you don't want to get the police involved, tell them you let her stay for a few nights now she thinks shes living with you and won't leave, THEY will get the police involved if she won't leave, or skip right over that and go to the police, tell them you offered her a place to stay, and now you want her out and she won't leave, they'll get her out!

I agree, you can kick her out. It can especially be bad if she isn't on your lease and the manager finds out - just throw her crap out and if she refuses, get the police involved.

Too bad the person above me is wrong and you can lock her out. Kick her out. My ex kicked me out and I wasn't on the lease so the police made me leave.

Sorry to be the bearer of bad news but u can lock her out, its illegal eviction.  Even if she is not on the lease she has established residency there.  You would have to go through the eviction process which takes about 30 days. If you can prove non payment of rent you can do a 3 day eviction.  Its best to cover your you know what with people like that.  Sorry ur dealing with this.

Change the locks put her stuff out on the door wen shes out so wen she comes back her stuff be out and the lock will be changed so she wont be aboul back and and she cant do nothing about it b/c her name is not on the apartment and she vaiolated the deal of no pets   good luck :)

Seriously! If she isn't on the lease then you can say she is an intruder and have the police deal with it. She's not your responsibility to take care of how can she even say she is not gonna leave. Or I'd do what mommyofaria said when she's out put her stuff out and change the locks. Gah so sorry you have to deal with this while your on vacation. ): no fun

And tell him he didn't have to give her half the rent back she was suppose to pay that and you clearly told her NO DOGS...her parents don't run anything!!!!! That is YOUR place and you do not have to put up with her bullish......I would just put her out without question

Anyway, he had juss gotten off at 3am-7pm shift so he was tired. Well im a little gormobal and it made me mad that it was my first day gone and I still had to deak with it, so I txtd her n told her to get the dog outta the apartment n it wasnt allowed back. Well she calls my fiance and says her parents r on their way to get her dog and that they wanna talk to him. They get there and make my fiance give back ger half of the rent, and left. I was furious. So I txtd her n said her things bte be out by Monday, she calls me telks me im an idiot and that sge isnt moving out BC its her apartment again, she is not on the lease. First off, all of u know, do not! Yell at a pregnant hoemonal girl, I went off!,well she is refusing to move out, ive only been home for 5 days, and now she is msging my fiance telling him to leave me and hitting on him! Im furious! She is 21 and brings random guys to the apartment all the time to sleep qith thwm, my fiance wuld nvr cheat! He keeps going off on her, but im so stressed out that im having dreams that thwy are sleeping together, im getting aggrivated and I still have 15days of vaca left. I dont wanna go home early, but idk what to do anymore. Im juss so stresssed iut. This was suppose to be relaxing... Sorry I juss needed to tell someone! Ugh
