There is no real way of knowing how long he has been infected.
Whether there are sores or not, there is a risk of transmission due to shedding of the virus outside of outbreaks. The risks are small, on average a 10% chance of infection for a year of sex.
The chance of an oral infection is very low, not a favored place for HSV2.

but his were always hsv1 ad hsv2 igm only
this test he got back today that he tested for when he had the symptoms last week came back IGG POSITIVE FOR HSV2

but we had sext two weeks ago when he may have been shedding before his breakout last week. i am worried

If your partner has not had an IgG test, then he has no evidence of being HSV 1 or 2 negative. You can have the virus and typically test negative on IgM, which would only return sporadically in the body. Hence most people with an established infection will test negative for IgM. Only IgG antibodies are permanently in the body.
I also assume your tests were type specific for HSV1 and HSV2? They are negative so it doesn't particularly matter, but it is better if they were. You would hence have four negative results.
Did he cheat? The test results will now not indicate whether he has or hasn't, only he can tell you that.
Does he have HSV 1 or 2 at all? Only a proper IgG antibody test type specific for HSV1 and HSV2 will tell. He may have had HSV all along for example.
The absolute best thing to do is ask this partner to get the right testing immediately. It would then be a good idea for you both to get tested in 12 weeks time to confirm (in case the IgM is a sign of recent infection).
