herpes and fingering

Ive been messing around with this guy and he fingered me a few times I tried my hardest not to let him touch himself after (at least 30 seconds after...not sure if thats long enough) . Now a few days passed and he said he has a cold and chills . I am very scared because I had the same symptom when I was diagnosed . Please tell me the likelihood of him catching it and the likelihood of me passing it if we decide to have sex. Should I tell him?

Thank you so much I decided not to ler him touvh down there again but last night (during an outbreak to the right front of my labia) we were spooning and I am woried be cause I had on a thong and he just had his penis out rubbing behind me and put his penis on me over my little coverage (mesh) thong so im just really paraniod . This all  happened so fast under 1 min as I quickly tried to get me off of me. Likelyhood of him reciving it ?could the outbreak have come through the mesh ?  Is it lower being that his penis didint go in the area of the outbreak (also ive been on valtrax this week) im planing on telling him this week but im not sure how help :

he did not contract your genital herpes this way.

should you discuss your genital herpes prior to sex? yes you should. If you don't and your herpes is transmitted to that partner, they can pursue legal action against you.

It's always a good idea to discuss std testing, hpv vaccination and std history with a new partner prior to sex. Most folks do not get std testing done and those who do, don't always get it performed at the proper times to be accurate. Also if a partner never uses a condom, you want to know that too. Discussing your own known genital herpes infection and what steps you take to protect a partner shows you are a honest person who cares about others too which is often fairly attractive to others :)
