child support :/

I'm sorry if this is really long, but I really need help. So my husband supposedly had a kid with another girl and his paying child support for the baby, but we have recently found out that is not his kid and the girl was a month pregnant. I guess the mom and the girl knew it wasn't his but they decided to file child support papers anyways. They went to court for custody she got it, and my husband said he wanted a DNA test. The judge asked the lady if she had asked him for one and she said she did and that he denied to take one, so the judge told him to file papers for a DNA test and stop paying child support for a kid that's not his, and invest the money on his own little one, but now he was a warrant for a DUI since he couldn't make it to his community service b/c of work. Would the DUI warrant affect him if he files for an order by the judge to get DNA test since the judge gets all of the information.

Wait wait wait they can't make you pay child support without proving if the child is his or not. Nd since he is in the system i would say yea the would know he should turn his self in because he is considered on the run...

They aren't going to not approve a DNA test because of a DUI that has nothing to do with it but he does need to turn himself in.

I don't know how child support works where you live but where I live the only way to make someone pay child support is if they sign paternity papers saying they want to take responsibility for the baby and claim that child as theirs with or without a test. Or if they have gotten a test and child child is proven theirs. If he signed those papers it's going to be really hard to get off child support. My dad did that for my sister and had to pay it until she was 18 and now he owes back child support because he didn't pay it. She's not his DNA but he signed the papers and took responsibility. As for the DUI he should turn himself in like they said above.

Same here. Where I live if you go to court for child support a dna test is required unless the father says there's no reason for it to be done.....example my husband and I have been togeathor for almost 10 years.....if we ever separated and I filed for support if he says there's no reason for paternity test bc he knows our kids are his then that will be that but if he asks for a dna test they have to give it to prove the child is theirs so they don't pay support on a child that isn't theirs.
