So I'm pretty sure my addiction problem caught up with me. This morning I had a missed call from the doctors who's name I used and from the local police department. They didn't leave voice mails but I'm scared again. I don't want to go to jail. I was an idiot. I have no criminal record and I have never done anything like this before. For those of you who don't know my story go and look back at old posts. Can anybody who has done prescription fraud tell me what my punishment can be? Am I going to get arrested? God what am I going to do? I know I have to pay for what I did but it's just my son and I. Who will be with him if they take me away in handcuffs?

I am thinking that she is not sober and that she did the recent fraud and is scared to death.  I think that is what she is trying to say.  Please correct me if I'm wrong.  There has to be someone she can call for help before she talks to the police.

Sounds like a lot of Law and Order watchers here! (smile)! But seriously, you are getting the best advice! Don't talk to anyone but your lawyer! Period, end of story! We will be here for moral support, always! Like I said before, TRY to relax, gather your thoughts, make some notes so you don't forget things to tell your lawyer, make sure you have all the details of your situation straight! Be calm! I'm praying for you, lots of people are! Stay strong!

No, you are entitled to phone a lawyer and they will provide you with a list of public defenders.  You can phone the lawyer and it will be up to him to get you out.  You shouldn't have to wait long for a lawyer.  It will also depend on how serious the charges are whether or not you will need to bail out.  You could be just released with a promise to appear.  The police will try and intimidate you and remember they lie.  If and remember that is a big IF you are charged, your lawyer is who you should trust.  
I love the police and all but I am thinking of you right now and I know how scared you are.  If I was in your situation I would want someone to tell me what I am telling you.

They could only hold you for a little, but if they are calling you they are hoping you will talk and make their job easier.  Remember...what you say can and will be used against you.  Get a plan in place if they do come (and I dont think they will) for someone to watch your son while you are down there.  I know this ***** honey, but it will work out I promise!

I will get a lawyer I'm just trying to think it I can't afford one and need a public defender will they make me sit in jail for hours even days before letting me go.

As someone who has been in a similar situation.
.absolutely do not speak to the police without first consulting a lawyer.  I know you mentioned cost etc and may have to use public defender, fine...you do not have to talk to them, however they can arrest you and hold you for a bit.  You have rights, dont forget that.  Right now you need to protect yourself and your son.  If they had enough to arrest you they would have done it and not wasted the time to call you.  When I was being investigated my lawyer called the detective on the case and did like an early intervention.  The police never called or came to my house again, they knew I wasnt talking.  I know you are furious with yourself and want this over, but dont bury yourself girl.  This will all work out, and you have done so much to fix yourself.  Hang in there, be strong, make good choices.

I don't know but I wouldn't talk to them until you consulted with a lawyer and that is the first thing a lawyer will tell you. DON'T TALK TO THE POLICE.  Everything you tell them will be used against you.  I'm sorry but just because you confess will not necessarily mean that they will go easier on you.  
It's all about convictions for them.  
You need to talk to a lawyer first.  I don't know how many times I can say that.

Looked it up and it's 5 years after discovery. My thing is if I wait for a public defender is that going to make me have to sit down there longer? I mean will they makes me wait and wait hoping I will just spill my guts?

I know that I am very naive about things, but I find it so hard to believe that now after over 4 months they decide to do something about it! It just doesnt seem logical! I wonder what the statue of limitations is? Plus don't they have to charge you with a crime within a certain time period! I don't know, but maybe just maybe it's not as bad as you are thinking! Insure hope so! It's times like these that I wish I would have become a lawyer! Just thinking out loud! Try to relax honey!

I agree with Bkitty! Please try to relax! I know how hard it must be! I'm sure your mind is all over the place with trying to think up all different scenarios! Don't go there! Just get you thoughts together, have a plan, speak to a lawyer... Remain as calm as possible! Drink some relaxing tea or something! We are here if you want to talk. So many are praying for you! Oh yeah and I am remembering all the bad stuff I did while taking pills! You are not alone! Big hug!!

:( I can imagine.  Everything will work out though.  Maybe just call them again tomorrow, if you can't get through the number they called u on, maybe try the nonemergency number and just say you missed a call and were calling back.  Or, you could call the doctors office, but i think u mentioned that u didn't want to do that. I was just wondering if talking to the doctor and explaining the bad place u were in at the time and how you are now sober and in aftercare, if that would prevent it from turning into a legal issue.  Not sure how it all works, but you won't know until you talk to someone.  I am sure they will try calling again.  Hang in there, we will give you as much moral support as possible.

Sweetie I dont think they will come and snatch you up tonight. More than likely they will ask you to come in to the station for an interview. I know that doesnt ease your mind to much. Im hoping you can get some rest tonight and put this all in God's hands. You will get thru this and you will be OK. ((hugs))~Bkitty

Do you have an NA sponsor??  If you do they may be able to help you prove that you have been clean and going to NA. If you have to take a drug test to prove you have been clean for 130 days.  Keep trying to get hold of them and have someone as back up for your son's care.  You can do this and you have had some good advice.  I hope all goes well.  I know you are as terrified as I would be in your place.

i think the cops may be calling to ask you to come in for questioning. they do that in my town when they know you have kids, are a single parent etc. avoiding them is the worst thing you can do, that just pisses them off. but do get a lawyer to go with you. if you call one they will usually give you a first consult free and then tell you if they can help you and how much their fees are. here they also let you make payments to them.
dont beat yourself up.ive done some dispicable things for pills, things im so ashamed of.most of us have. and i firmly believe that everything happens for a reason, do you believe that? keep us posted...we're all there in spirit,

You are very welcome Scaredmommy.. You will get thru this.. just do the things you need to do and you will feel more confident.. I know it is scary but with the steps you will be taking things will work out for you. when you gain a lil control You will feel much better !! I'm from the south, and a couple yes ago, sime of my husbands acquaintances committed 20+ counts of rx fraud, first time offender, she recvd' 12 days in county, until a 5,000 biond was posted, afterward I'm  thinking 6mo or 1 year in rehab (family had to pay for.)  Now 2 yrs later,still on probation for 3 more years, and weekly and sometimes bi-weekly urine tests.. But like I said, 20+ counts, so depending where you are and your laws, if you have one count, punishment might not be that severe, but she us now, 2yrs clean and sober.. Best of wishes  and GOD Bless

look for legal aid some do it on a sliding scale you just have to start making the calls.. It will be confidential so you have no worries there but get on the Na signing and keep a journal with signatures and that letter it will help you a lot.. Most judges are pleased when they see you have taken the steps needed to get clean and straighten out our life without being forced too.. Try not to worry but do start calling around ok.. Everything will work out as long as you are on top of things.. Do not let them blindside you.. Be Prepared....

Oy' if only they were free. I can't avoid the police and I am not going to speak with the doctor at all, I see no need to if it's a legal matter now anyways. I am hoping I can find legal advice that I can actually afford or I'm up a creek without a paddle!

Hi Scaredmommy.. Congrats on your 130 days !! That is Awesome.. I would suggest as the others did to lawyer up Also since you have been attending NA ask the to sign for the days you have attended.. Every time.. also if you can get 1 to write a letter that you have been attending 3 days a week for 6 months that would be great.. Now is the time for you to be proactive in proving you have made the changes necessary to become a honest and productive member of society.. your clean record will help along with the Na and a Lawyer.. let him do the talking for you ok.. this will all work out. even of you had to do some time maybe your parents can watch your child although with the steps you have taken to get clean and proof you may not need to worry about that.. I wish you the very best in fighting this. I know you just want to get it over with but be Smart about it ok.. sending up a prayer for you.. lesa
