SECOND TIME BUSTED FOR FRAUD RX

On August 21, 2008, I got caught buying tramadol using a fake name and fake call in RX. The agent did not arrest me he asked for my id and found out my real name, and had me write a statement about what I had done. This is my second time getting caught, the first time was March 5th, 2007. The first time I did not get caught in the act, I called the RX into the pharmacy, under my ex-husband's name who at one time did have a RX for tramadol. I went to pick up the RX and they told me I had to come back tommorrow, because they were out, they asked for a copy of my driver liscense since I was picking up for someone else, and stupid me gave it to them. As the day went on I kept thinking something was fishy, figured they were on to me and never went and picked up the RX.

The pharmacy gave my ID to the police and they called me and questioned me, I told them that my wallet along with my ID had been stolen and did not know what they were talking about. Two weeks after that phone call I was arrested at work, I lost my job of course (Osceola County Health Dept). spent one day in jail. They charged me with a felony, but dropped it to a misdemeanor. I plead guilty and received 6 months of probation, no drug testing or counseling involved and 20 hours of community service. The agent that caught me the second time has not filed any charges yet he wants me to be a Confidential Informant in other words a snitch, he says it will help me when he does file the charges, he said he has up to three years to file. Does anyone know what I should do??????????

Tran, do the following.

1: Go to an NA meting, get a sponsor. Tell them about the situation, be up front and honest. ATTEND at least two meetings a week.
Ask your sponsor for a letter if he can't come down to court with you showing you've been going. Be realistic, tell him you know he can't do a glowing letter of recommendation as you're so new. He/she will respect that. Or should.


2:  Look into any kind of outpatient programs you can go to for counseling. Try to get some sort of documentation showing you've enrolled, or have started attending if thy can take you right away.

Take these documents down with you. Courts are much more impressed by actual, physical proof of your intent than just your word you'll do better.

It would help if you can provide a drug test showing that you're clean, but I don't know if you could get the results by the 5. If you're clean now and go in in the next few days, you may get it in time.

At least with these proofs, you'll have a better chance of probation only.

HELL NO you can't snitch, don't even consider that.  The courts go VERY easy on people with drug issues.  I know that this is an old posting.  Did you end up giving in?

I remember you from well over a year ago and all that you have gone through. I remember a post where you took something like 40 or 50 pills at once and had this community in an uproar.  I pray that you will go to in-patient treatment and finally get the help you need. this is it...rock bottom.

Jails, institutions and death. I will promise you that. There is only so much you can do before it is inevitable.

You haven't posted in 7 months and only do so when there is a disaster. If you stuck around and listened, you could get help. I personally do not want to see that you are back and further see another OD post. You need to wake up and realize you have a problem. Your child transitioning into high school is the very least of your worries.

Please, please get help. I will pray for you and your family.

The charge from August 21, 2008 has been charged as a misdemeanor not a felony. I could still do jail time, but hopefully they will give me drug court. I wiil find out at my pre-trial hearing on July 24, 2009, that is when the DA may or may not offer me a plea agreement, anything except jail time I will agree to. ie, community service, probation, drug court. I deserve to be punished but I don't see how sitting in jail will help me. It will also affect my 14 year old son who is starting highschool this fall. I am his primary caregiver and we all know how hard the transition to highschool can be.

I feel I need to be available to him, in case he needs help with peer pressure to do drugs or other things. I can help him by using my own experiences.

just wanted to let you know my friend had the same thing happen to her and she almost ended up shot cause she was with the undercover agent when he was going to bust them and she didnt know it was going to go down that day i know cause i was babysitting her baby when she called me paniked and shaking. they are full of **** and they also offered her money knowing she was broke and raising a baby by herself they promised to get her hubby out who was in for domestic against her which she did not file charges they had goten into it and thy arrested him and he was the sole support she had then they offered her the deal doesnt it sound like they had her where they wanted her. dont work with them they are liars and worse they will then work with whoever you snitched on to get to the bigger dealers. and then they willall be after you thats what happened to her they also told her noone would find out and if someone did they could relocate her and her baby guess what they didnt arrest the one she snitched on because he was going to help them so then he was out of jail to look for her and when she called the officer back he wouldnt answer the phone so she ended up  with 50 dollars and on the run and hubby is still in jail. sorry so long just want you to protect yourself. dont do ittttttttttt.

ur boy is doin 3 - 5 years for distributing drugs NOT BC OF A DAM SNITCH!!!!!!!!!

FUK A DEALER, snitch all day save ur *** they sure as hell dont care nothing about u me or anyone else, they just money

and, also---since they dropped ur first offense to a misdemeanor....they may not be as likely to drop it again (of course if u snitch im sure they would)

I was unfortunate enough to land in a Federal Prison for three years for a kilo of white......you do not wish to go anywhere as a snitch - - - just isnt cool at all - - -and the earlier post that reminded you that that even the cops using the snitches have no respect for them is right on......quit talking to anyone but your attorney.....one will be appointed if you are arrestted - - - - good luck to you - - -

Do not snitch on anyone....seriously. I wouldn't.  One, u run the risk of ppl finding out who snitched....you have a kid and yourself to worry about. I mean, NOBODY wants to go to jail and I highly doubt you will.....but, id rather go to jail for some time and get it over with then be a snitch and have to worry about that the rest of my life.....

You could go to jail tho even if it is your first felony.......my bf did.  It was his first time in toruble, with drugs, and he got a felony 5.  Course, we live in Ohio and they are strict here.....he even had a really good attorney.....but see attorneys are in bed with judges and it just depends on favors for each other, etc.  He did 1 years jail time for less than a  gram of coke. No priors. And, he asked for **************. Jusge said no. Maybe the judge just didnt like him.....or wanted him. Anything is possible but still.  Someone above said it is up to the judge and they are so right on.  Not to mention, I have never heard of an informant getting paid $50-$100 per bust.

In order to avoid this or that or awkwardness........id tell them u dont wanna snitch because u are a recovering addict, been clean and really fear if you go around your old connects, you will relapse.  That is respectful and i dont see how they can argue that.  What would they said "Well tramhamilton, that's great ur clean now but go ahead and go buy drugs so we can put more ppl in jail and make more money"  They cant say that.  

Be honest with the judge because he is the one who will call the shots.  Also, get an attorney if u can afford one. I know they are mad expensive but they of course will work for you and get a deal with the prosecuting attorney.

My connection (J)  got busted selling oxy 4 times to a "friend" trying to ease his sentence. J sentence was published in yesterdays paper. He got 180 days suspended and 2 years probation. the probation is the hard part because he has to **** test for 2 years.

I would say DONT  inform. The informant did more time for his offense of selling oxy than J did. Not even the cops respect informants and they make sure the people on the inside know what they are. It's not a good place to be.

Hi there sorry bout your tough situation but I would go with the majority here.  I mean you can cause a whole new set of problems for you and your son.  I dont know who you were dealing with but I used to deal with some pretty dangerous people what if a family member or loved one that you snitched on comes after you and your son.  Not trying to scare you but It could happen.  You dont want that reputation word will travel fast after the first person you turn in  sounds scary to me  I would just swallow It and see what happens there's still  a good chance you wont do jail time.  Do you live in a small town, big city ?  Good luck and my thoughts and prayers are with you and your son.

I couldnt turn people in that i knew used...i was one of them....not a brotherhood or anything but just dont seem right somehow...what we do comes back to haunt us...in this case getting others in trouble does not seem like the answer...u will be fine..u r clean and life will get better and better....dont do something that will compromise ur values and put u in places u dont need to be right now...bad places....i would take my due which i am almost positive would not be downtime as my friend was charged with this exact same thing but it was vikes...had to go to meetings and be on probation for a year...cost some money as well...but it is over and she can lay her head on her pillow and feel good about herself

Here's what you do: If you can not afford a lawyer, call the public defender in your county and tell them EXACTLY what the cop is asking you to do. DO NOT DO IT. The cop can not guarantee you ANYTHING!!! He is lying his a** off. He has NO discretion to make you a deal. None whatsoever, it is totally up to a judge. The public defender will call the cop (who's just using you to make a name for himself and make you a rat....you DO NOT want to go to jail as a rat...trust me on that one....and there's no guarantee you won't) PLUS, Florida has been all over the news for bullying a FSU student into being a snitch on a felony pot charge and she was killed!! Your crime is viewed as SO MINOR in Florida. The worst thing they will do to you is probation. The very worst. Your crime is a third degree felony punishable by up to 5 years in prison but in the last 15 years I've never seen ANYONE go to prison for tramadol RX fake prescription. Most likely, you'll get drug court or PTI (pre-trial intervention meaning be good and we'll drop the charges). I can't guarantee you won't go to jail of course but put it this way--- I'd bet my bar license you won't. I'm that sure. Call the Public Defender. If they say they can't help you until you're charged, then shut up and wait to be arrested. Put aside about 500 bucks for bail (at most) and you'll be out of jail in less than a day. Then you will get a public defender if you do not have the money. Also, confide in somebody you trust and have them lined up to take care of your son in case you do get arrested and bring the bail money to get you out. Call the cop and tell him you are not going to be an informant and DO NOT MAKE ANY MORE STATEMENTS TO HIM WHATSOEVER.
Good luck. He's just trying to scare you and help him. He doesn't give a flying flip about you. You will be fine.

I have to agree with everyone else...take responsibility for what you have done and don't look at what appears to be an easy way out.  I have nothing but contempt to agents who worm their way into peoples lives, making them feel worse about what they have done.  They are just trying to get their hooks into you and could always hold what 'they did for you' over your head-threaten you with bustin' you back.
Stand up, take your knocks now and deal with the reality of what you did.
Ask for help with keeping off drugs and point out you are clean.
With the way jails are freeing really bad criminals, how could there be space for you?

he wasn't a "dealer" like you're thinking.  He got some stuff for a "friend"... that friend ended up being a snitch.  Hes just an addict like the rest of us and sitting in jail hasn't done him any good.

For real - don't snitch.  My boyfriends doing a 3-5 year sentence on a drug charge cuz of snitches...  You have no idea what that does to families. Plus you'll be known as a rat for the rest of your life - what would that do to your kid??  Own what you did and you'll be fine - you're an addict they have drug courts where you can have your case heard.

OMG do not do it! That is horrible!!! I mean, you get less time, and they get their lives f*cked!!!!
In the end if you just go to court, you are not going to get in all that much trouble. Some yes, but you have a drug problem and they will probobly put you in a program for that..........or something!!!!
