if drugs were involved then i believe yes they could take the baby. be proactive and try to fix the problem.

I live in Texas and have never heard of Child Proctective Services just taking children for no apparent reason. I have taken my child to the emergency room for an accident that happened and they did not take him away. There has got to be an investigation and it takes quite a bit of evidence to take children away from their parent. Courts tend to want to keep families together. I am sure you were ordered to parenting classes.
Did the child injest drugs or something? We really need to know the truth in order to help you and as said above this is anonomyous.

Like the other comments say, I think we'd be better able to give advice to you if you let us know what happened. Were there any substances involved at all? And I do not believe they can just take your new baby away when he/she is born unless they find significant reason, like drugs/alcohol or abuse/neglect. Depending on what made cps take the other kids away may cause them to monitor you after the new baby is born. Let us know, there's no judgement here.

Texas law is the same with regard to removing a child or children from the household. There has to be proof of neglect or harm to the child before they will remove the child from the home. I am also curious regarding what happened to your child - an ER visit alone would not substantiate removal of a child.

i am so sorry for them taking your children, As for the one your pregnate with , i'm not sure of the tx law but here in oklahoma they can't touch them unless they have proof of any harm or neglect.. But what i want to know is what happened to the child?? They had to have substancial evidence to take the children away.. they usually investigate the problem first ..
