video proof

Dear Legal Lad,

My name is Mike. I'm a victim of Identity theft and possibly accused of prescription fraud as someone that looked like me went to get a prescription filled and then left to pick up the prescription the next day. I got text msg to "Pick up my ready percriptions" from a free SMS service from Walgreen's and I know I did not have any prescription then. also this was in another city next to my city. I called and the lady said that someone was there the other day that wanted to fill a prescription but she did not. I told her that I was a victim of identity theft and not to give it to the person.

But before all this I went to all the pharmacy's and made sure that I don't have a prescription that is filled for me while doing so I made myself a suspect. I have a Police officer from the other city calling me asking me to come in to view the security footage that he has I have had no time but I stopped by when he was not in and left him all my info and docs of who I think is the person that stole my identity and has been using my credit cards. He does not give a **** about that all he wants is desperately for me to go to the police station in that city to see the footage. He told me that otherwise he will have to close this case and he wants me to come in.

Now while I don't remember what pharmacy's I visited I also don't want to be the person on this footage that he has. So he keeps calling me almost every other day. I left for IL today and won't be back until Thursday I told him he said no problem.

What are my rights ?

Do I have the right not to go and see the footage ?

Why did he say that the case would close ?

Does he have a certain amount of time to crack this case ?

When I visited the police station in that other city he was not there and I gave him all my police reports and few pictures of the person that I believe stole my Identity. The officer told me over the phone that "Its not that person that's on the footage" so this right away makes me assume that he is talking about me. I don't want to get myself mixed up in all this bureaucratic **** and then having to proof to the court that this is not me when indeed it might have been me visiting one of the pharmacies check if I had any prescription as I kept getting fake SMS msg sent. In the mean time I filed over 3 police reports in my city about my stolen passport, credit card transactions, and now few threats.

What are your thoughts on this.

I would assume  that he has Jurisdiction laws and can't come to me ???

I also assume if I go there I put myself in a potential danger ???

Be smart -- get a lawyer before talking to the police anymore.

Mike -- how addicted are you?  Do you have to use every day?  And what have you been using and for how long?  Just trying to get some background info.  I'm concerned about your addiction, and I'd rather see an addict get clean than go to jail.

Get a lawyer -- be honest with him about your addiction.  People here will help you with what they can, but if I were you, I'd talk to a lawyer.  If you've never been in any trouble AND you get clean, you can probably avoid the legal hassle.  You need to be honest with us and a lawyer.

Oh, and where do the threats come in?  It sounds as though you may have gotten mixed up in more than just this situation.  Be careful....if you fear for your safety, go to the authorities.  Do you have a family/wife?  If so...she needs to know what's going on, especially if there is danger lurking.  Whoever has a bone to pick with you may decide to target a loved one rather than you.  Not trying to scare you, but you need to think of these things and handle this right.

Mike...good for you for being honest...it's the first step.

The police are going to find out about this sooner or later, so my advice to you is to come clean with them asap.  Admit you're an addict and that you're seeking treatment.  If you can...find yourself a good lawyer.  You'll surely have some consequences to face, but it is better than keeping the lie going...especially since you've already lied to the police and filed bogus reports...that in itself is a crime.

So...bring this all to an end now and be the one who comes clean with the cops before they find out anyway,  They're not dumb...just being avoidant of coming in is a huge red flag to them I'm sure.

This i s Mike sorry about that this was my paste and copy... I am the person that did this I bought the script online its a site that you send them any kind of regular script and they create a real like script and send it by mail to you after you can go and pick the med of your choose. So this is where my problem is. Can someone help me please!!!! What should I do. The real truth is that Before this happend I did report to the police that All my stuff got stolen from my car and along with real perscriptions. I do also get calls that someone wants to kill me but I recorded the person and I showed this to the detectives in my city. What should I do about the other city please help me.

Thought one thing that should be added is nobody here will judge no matter what the truth is. You can come clean with us on here and we will help you in anyway we can. That is the one great thing about this site. Many of us are addicts and have all done things we are not proud of so we are in no position to judge even if we would. Just be honest and we will support you 100% in helping you get clean. If you are being honest you should have no worries and I would want to talk to the police to try and get this guy busted as identity theft would cause quite a headache. I know if a police officer wanted me to come to the office and I had nothing to hide I would bend over backwards to get there to get things figured out and get the sob behind bars!
We are here to help so please explain the situation more clearly so we can help!

Also..u had pics of this perso?  is it someone u know?  if it is a friend then it can cause problems....also if not refill was due//how could this person be getting refills called in?  it is rare for even the patient to be able to call in for early refills..sumpin doenst jive here

also...they zoom in on those pics...very high teck equipment those cameras r these days.......if the person just looked like u but wasnt u..they can tell with zoom in on the perputrator..

i have the feeling we may not hear from u again more on this situation

number 1>> are you an addict?  u found an addiction forum to ask this question..most of us//beleive it or not never did fraud rx-s

2.  why do u  visit so many pharmacies
3. if indeed this person stole ur identity,..uneed to show documentation of credit card use etc where he used ur identity..or did he do it for the sole purpose of pickin up ur scrips???unusual for someone to steal an identity and only pick up scrips...as a rule a person who steals ur identity doesnt even know bout scrips..they get credit cards etc in u name and charge them up...get a license/drivers etc...they can check the drivers license office quickly as if u did not go get a new license and this person did..it would come up...tons of ways to prove it...just never heard of a ID theif only pickin up scrips with no further use of ur name...or was there?  if so u need to prove this

I also agree it sot of seems like you are trying this story to see if it flys. If we have so many questions and can see gaps , a trained investigator surely will. Are you an addict?

I agree with the other posts.......  you are a victim of identity theft,  it is the police or legal authorities responsibilities to prove to the DA, if they have evidence that  you should be charged with a crime...  until that happens......  you are having a whole lot of speculation and concern  for something you are completely innocent...  It is not necessary for you to run from city to city over some "maybe"  legal speculation of which you are innocent.   You didn't do anything wrong,  so  no worries.  So why are you so concerned?

I wish you the best of luck with the resolution of your situation - - but you dont sound like you are telling us the whole story. The Officers jurisdiction should extend throughout the State in which you reside - - and many times there are reciprocal agreements with adjoining states.  Most innocent folks would make any amount of time that the police ask for to be exonerated......You are already mixed up in this, dude - -  And unless you have a prescription bag in your hand on security footage it doesnt mean a thing.  There are lots of legalities and even the 5th Amendment to the Constitution to keep you from testifying against yourself - - - unless you want to!  There should also be security footage of any credit card transactions - -     Good luck - - -

also, the security camera's have the time on them.  There would be different date/time from when you were "checking" on prescription and when someone "fraudulently" picked up your scripts.

so...you sound VERY guilty and I dont even know you.  Why arent you cooperating with the police?  And, you said you "cant remember which pharmacy's you went to"  Thats VERY odd.

But most of all....If you did nothing wrong why are you so worried?
