medical mistake??

I believe/know that the pain clinic Dr. hit a nerve during the transforaminal injection procedure and I might be permanently damaged (it's very painful). How should I proceed with getting care?

I feel since it was their mistake that they should pay for my medical care now?

I haven't gone the legal route though some errors were made in my care also. Those "needles" going into spines are a very delicate matter. When done by a very skilled and experienced practitioner they can be very beneficial. However skilled or not errors happen. Frankly injections frighten me.... but when we are in pain we'll do about anything to relieve it.

I wish you well and hope you'll find som relief. My friend has had great success with RFA. She swears it has given her back her life. How wonderful! I wish the same for you!

Your right it is sort of a legal question but I was was kind of looking for someone that might have had this happen to them?

I am just concentrating on the pain management part. I've been given pain patch and I might try to do the RFA on the side they hit the nerve on.

Hi Joojee,

I am sorry to hear that you were apparently injured during an injection. You've asked a legal question that can only be answered by a member of the legal profession.

Check to see what you signed prior to the procedure. Often the medical release does just that, releases the practitioner from fault.... meaning you assume any and all possible risks. However I am not a legal consultant and cannot advise you.  

I hope you are able to find good pain management. We know how difficult that can be in itself.
