Raevicious....although the above poster is correct about certain states. Most states now have common law about women and maternity leave. I work for human resources dept. that covers most of the east coast. PA NJ Ny DE and maryland. So I would just find out what your rights are for maternity rights in your state.

Depends on the state. It's not required in Az for employers to provide maternity leave. It's a right to work state. So if she doesn't meet the companies requirements for maternity leave, they don't have to give it to her.

It is illegal for your place of employment not to grant you maternity leave. Although it can be unpaid they must secure your job position and same salary for up to 6 weeks postpairtum or at a dr discretion. FMLA is a family medical leave absence which is differnt from a maternity leave. Employers dont have to grant this. But all this is..is an extenstion of your medical leave up till 12 weeks. But you must be granted a maternity leave or it is consider as discrimination. Unless you work "under the table" your kinda outta luck there. I work for a human resources dept. So if you any question feel free to ask. Good luck to you!

I was just telling my husband I want to work up until I go into labor. Ill just be lazy there. My job doesn't have a maternity leave either. I work for something like a church. I want to work as long as possible so they will 9x10 see how committed I was, then bring me back on in 3-6 months. My plan is to save money and try to stay active.

I worked up until 36 weeks, if you'll have to quit, I'd do it as long as possible!
