Husband might get deported

My husband has an order of arrest & he wants to turn himself in once our certificate of marriage comes in the mail which should be any day now. When he was 18 he was sexting a girl who was 16 (her mom read their convo) & called the cops on him thinking they had sex but they didn't. He went to court & had a restraining order against him. My husband is now 22 & every time he sees cops he gets scared/nervous because he doesn't want to get arrested, he would rather turn himself in. I understand he's doing it so he doesn't feel like he's "hiding" all the time & so that we can be happy & go out without worrying about him getting arrested but I'm scared. My husband said there's a chance he might get deported & it makes me really sad but I respect his decision & plan on being there for him.   We already talked about what I would do in case he does get deported but just thinking of him getting arrested breaks my heart. :'(

If he turns himself in.. they do give him less time in jail.. and I doubt he'll get reported my uncle was accused of raping a girl because she got caught having sex and she wanted to b tge good girl in the situation. . Hes out and well he did face a couple of years in jail but thats about it

Before you do anything you need to consult a lawyer he will check his record and let you guys know what needs to be done. Im in the process of getting my husband papers and he has a order for removal do to a DUI but immigration is still giving him a chance to apply for a family petition do to us being married and him having two US citizen childern. Defenitly go talk to a immigration lawyer first.

Is he still facing charges for the sexting? I had a friend who's brother made a mistake and sexted a girl who was 16 (he was 19) but she claimed they had sex and he was given 6 years for statuatory rape, however that's probably different from what your husband is facing since it doesn't sound like the mother claimed they had sex. If you're a resident then he shouldn't be deported, basically you're his green card. As for applying for section 8, you'd have to wait for him to turn himself in I believe. Once he turns himself in then apply and explain to them that your husband is in jail and you're desperate with a baby. They put parents with kids on the top of the list from what I read online (I've never applied or used it so I can't say for sure).

No, he only missed court dates when hhe had the restraining order & he didn't get deported before because he had moved & was hiding for some time.

If your trying to get papers and your planning on being his sponsor you can't be on state help or you have to have a cosigner/sponsor in order to do so. When getting papers they look too see if you can support the family you have. If you have any questions in regards to papers message me. I will answer them.

If he missed court dates for parking tickets and stuff all he has to do is go to court for them. If he isn't a citizen why didn't he get deported the first time he went to court for the girl?

No he's not a resident but another reason he wants to turn himself in is because I wanna get him papers. I was also wondering if we apply for section 8 will we still be eligible even if he has an order of arrest?

Is he a resident? See.. when you're a resident I believe you get only 3 chances. Lets say he has a felony for that. . Well only 2 more and he's out. Traffic tickets are not felonies and do not have any affect on him for sure. And about the felonies that's what I think I know cause my husband's a resident and I think that's what he told me once. Idk if its the same for every state ???. But don't worry I'm sure he won't get deported.

Thanks & he only went to court once & didn't show up to the other court hearings, he would get the papers & not show. Plus he also has unpaid parking tickets. I was a bit confused myself when he told me because it's so much to take in all of a sudden.

If your a citizen of the us (or if your even in the us) I believe he can't get deported. Not sure how it is anymore also better he does turn himself in cause they might not give him a bigger punishment. If you can I advise you to get a lawyer. I grew up with a lawyer in my family believe me they help somewhat.

Wow I hope everything works out. And yeah I would say it is better to turn himself in but you should consider getting a lawyers advice ,and might get help to put this all behind. :( But what exactly will he get arrested? I thought he went to court already I'm confused, sorry:(
