custody of child question .

I currently dont work . So my bd thinks if we split up he can get custody of our baby . I go to school getting my GED and planning to take college courses after & get a part time job, i dont do drugs or nothing. Unlinke him who chooses to make bad desicions that could get him in trouble. But our relationship isnt going so good right now. I have 2 more months until babys here & i dont think wel be together... im just scared he can take my baby away from me.. idk how  courts make the desicion...

Hi there.  Sorry it isn't going very well.  That stinks!  It will depend on your state in terms of how they divide custody.  Many states are actually not just pro mom but will give partial or equal custody to the father as well.  So, you may have to split your time with the baby which would be hard.  But unless you had something going on like positive drug tests or something like that, they wouldn't deny you custody and not just based on income definitely.  You'll maybe need to show you have a place that is safe and clean for the baby to live and a way to live (even if it is welfare) but they won't take a baby because you are struggling financially.  But, joint custody is very common as most courts believe that a child needs both parents in their life.

Well Texas is a mother state, and judge will most likely rule in mothers favor. The dad will have to prove you an unfit mother. It sounds like it would be easier for you to prove him unfit tho. Every state is different, the best thing is to call around and find out your legal rights and the best route to take.

I highly doubt it unless you do drugs which you already said you dont or mistreat your child I dont think hell have custody

Nine times out of ten the court always grants custody to the mom. If your not on drugs and doing all types of crazy stuff he can't take the baby!
