rights for baby.

Hey I was 16 when I got pregnant. I am now 17 and 17 weeks pregnant. The father and I just broke up and he is 19. He is trying to say he can get rights. I dont want my baby around him cause he smokes, drinks, and does drugs. I want to cut him off from my baby permantly. Is that possible because I jeard that since I am underage and he isnt that he cant get rights. Please help. I dont want him to have any rights!

Was he always such a charming guy?!?! :-/ I know how emotionally charged these situations can get during pregnancy. By the time your baby gets here hopefully all of this is a non issue. If your mothers planning on charging him for S.R then she should do it and not wait. That's nothing to be played with. PRAY on it. Just because you have the baby doesn't mean you have rights, or custody. You can take him to court to establish an order for child support and visitation/custody but if its going to be a legal binding order, then you've got to go through family court.

When you have your baby you're fine...you don't have to take the baby to him or anything ....the only way he can actually assert his rights is to go to court. Make him file and then you can bring up a drug test....done with hair not urine. You will be fine...if he has no contact for 6 months and doesn't support the baby financially for the 6 months you can file for termination of rights but don't do anything hastily, think of what's best for your child...sounds like you have a level head so you'll be just fine :)

no its not for hate. Im lookong at the best thing for my baby. He smokes drinks and does drugs. He is also aggressive and bipolar when things dont go his way. He has never been around babies. he didnt go to any appointments or bought anything but alcohol. he has even claimed the baby wasnt his so idk why he wants rights.

I would wait and see if he even tries to get custody, some men won't even bother, make sure you're saving emails, texts, voicemails, anything that wouldn't look good for him in court, and document everything. If you need them, they're available, if not, then great. Make sure you get a lawyer to represent you if it does go to court.

No job yet. But I am apllying places. I live with my mother. I dont do drugs or anything. my mom plans on charging him. And he was kicked out og high school for having drugs. he works but still lives with his mother cause he spends his money on drugs and alcohol.

I don't know the full situation because obviously haven't gotten to heart both sides of it, but I know a break up can set allot of fuses, and I hope you don't use your bitterness rewards the failing relationship to keep your baby from the father. A baby isn't property and its nothing to play tug-of-war with. Again I don't know either of you or your situation, but a court will look at both patents as equals until proven otherwise, and its a rough road to ride on

Save any stupid texts, voicemails, emails, etc. Document everything he does/says that is threatening, or unfit. He already has a statutory rape charge, or you could charge him with statutory rape? Unless he was charged with it, it doesn't matter. But any kind of criminal record doesn't look good on him, if you're in college full time, you don't do drugs, (do you work? If not, I would really try to get a job) have a suitable home, I wouldn't stress about it at all..like I said especially newborns, judges usually favor the mother.

Well technically is was statory rape even though I was willing. I have proff he does drugs because I have a message saying he knows how to pass a drug test if I take him to court. I am in college fulltime. Whag are the odds? How do I prove he is an unfit father? because he was agtessive with me and does drugs and drinks.

The father can get rights, and likely will get visitation at least, unless you can prove he's an unfit parent, but he can't get custody just because you're underage, he has to prove you unfit as a parent. Moar judges side with the mother, especially with newborns.

The father can always get rights, it's his child too. My husband got full custody of our daughter when she was only 8 months old and his ex lost ALL of her parental rights. Our daughter is now 2 1/2 and he and I have full parental rights and custody.

You age doesn't have anything to do with it. He is going to have to take you to court...
