I don't have a lot of input on the legal side but I live in Kentucky and we are an "at will state" which means the same thing but to be honest I have seen some really underhanded things in my last 20 years of employment! But this really takes the cake! Bottom line is...You need to take care of yourself! I have a firm belief that "what goes around, comes around" What is happening to you will come around to bite them on the butt! BIGTIME!!! Hang in there and keep us posted.

YEs I have used all my PTO time...which is fine I just felt like this is an excuse he has known all along I could have been more prepared then to call me on a Friday @ 10am after treatment and tell me this stuff. I will be fine.
This is just terrible. You should not have to go through this at all and especially not while you are trying to recover from cancer.

My husband works as a government liason for a not for profit org. He used to work as a legislative aide for a congressman and knows a bit about this legislation. He also had cancer several years back. But his employer was not the jerk yours is.
It all depends on how much leave you have taken so far. They do not have to pay you if your paid leave is exhausted, but I think they cannot terminate you when you are sick if you still have unpaid time legally available to you under federal law. I can ask my hus band when he gets home.
Do you guys have leave donation where you work?
Where I work people donate unused paid leave to a "fund" that people can use if they are sick and run out.
For those of you who don't live in a state like Virginia, the term "Right to work" is a " b.s" term that means the state discourages worker organization and is entirely pro business. It gives employers the "right" to dismiss anyone, at anytime for no reason at all. My guess is that this anti employee legislation is common in most of the Southern states.
The good news is that federal law (love those federalists) trumps state law. This means that if you still have a right to sick time under federal law, even if it is unpaid, they would be unwise to attempt to terminate you.

My situation has seem to resolve itself. This week I got an email from my company saying the prime contractor at my government work site had sent several emails regarding my performance issues to the govt contracting office and never got any response. He ran into my immediete govt boss who told him he did not have any problems with my job performance. So the prime contractor said he considers the issue closed and please tell Mary to quit send weekly status emails to him.
So for now, I concentrating on other things....like trying to find a new job because my govt organization is downsizing in the next year. My contract is good until Mar 2008. After that I may not have a job.
I think my old immediete govt boss who left just after my letter of counseling was written was behind the whole thing. With him gone, I think I can work comfortable with my new immediete supervisor. So finally things are a lot less stressful at work. I didn't realize how much the stress was affecting me until I went on vacation for a week and barely notice any heart palpatations.
When I told my endo about all the **** my work had put me through she told me I should have had here write a letter. I wish that I had, but at this point, I don't see any benefit. But with you, you need to document everything at work and get documentation for all your medical issues....including the side effects of being under so much emotional stress cause directly from you job. If you have any emails I would forward them to your home email address and/or print them out. I may still go to the Inspector General for the government and ask if it is legal to be counseled for going on disability like they did me.
In the mean time come rant here any time you feel like you need to....we're all here for ya!!!!

Do they know you are recovering from cancer? I agree with ChitChat. Get a do ctor to note your emotional distress. Does right to work mean you have no right to work if you have cancer? I'm mad!

I'd sue big time. And if they even hint at being let go you use the lawyer word and let them know .. then as you walk out look @ chicken head straight between the eyes and tell him that "I don't know how you put your head on the pillow at night to sleep". That line usually makes some kind of a dent in thick skulls.
So so sorry...................................................YOU AND YOUR HEALTH COME FIRST .. if this causes you any emotional distress you go to the dr and have it documented as they are responsible. He really needs his feathers plucked.
