thank you i will have to send them a letter now, i should have done that first, my contract does state that if you move out of the area you can terminate membership
i just researched this gym and wow they have so many law suits and complaints for this kind of stuff, they are only in nc and sc, maybe ga
not one out west where i live now
I went thru a situation like this a few months ago. You did the right thing by getting a new account number, so they can't bill that one any longer. Now you should get a copy of the contract, contact your credit card company again, and tell them you want to DISPUTE the charges. You can tell them that's why you had to get a new account number, so it's a good thing that you have a record of that. After you contact your CC company and dispute the charges, get your documents together ( contracts, all extra charges on your CC that were charged after the year) and mail the copies to the address the CC company gives you. They will credit back your money. Good luck, and the sooner you can do it, the quicker the response and your refund :o)
That's gonna be a tuffy. Getting out of those contracts are usually not easy. I have learned my lesson not to make contracts esp. with gyms. Unless you know and read that contract with a fine toothed comb. They do this chit all the time. I was told by the sales woman that I could get out of my contract at anytime with a doctors note. Well, I did just that......I submitted the note and got a puzzled look from the person I submitted too. Long story short.....they kept billing me ....the sales lady was no longer there and there were "no such statements" or Notations in the contract......
I got a new credit card and number. Stopped paying them.......was soooo pizzed !....They haunted me for 10 years, but it was all worth it. I was young then, so I didn't understand the reprocussions of getting a credit ding four 7 years........oiy!
Good luck, hun.......Wish I had a suggestion to offer other than go over there and glue the toilet seats together, and lots of baby oil on the showers floors, treadmills, oh, and a few baby diapers unloaded into the pool.........
keep us posted if you get those criminals.....
luv,
nauty...........
u would have to write to the gym, a written letter u can photo copy stating u have canceled ur membership and send the copy of the letter to ur credit card company. Do u have a copy of the gym contract stating u can cancel after a year? If u do then I would also send a copy of this to the credit card company with a short explanation that u have canceled ur membership but they are still billing u. This should stop the credit card company from billing u. If u have proof in writing that u canceled before then u should have no problem getting back money owing to u from the credit card company. But unfortunately, if it was only done over the phone, this may be more difficult. Maybe make sure u state in ur letter that u canceled ur membership a while back and give the date of the phone cancelation. Best of luck to u.
Is this a national gym? If so, do they have locations near you? If they do not have a gym close to you that should be enough to have them cancel your contract. Have you looked to see if your contract states anything about you moving and how that would work? I belonged to a gym once when we moved out of state and they had a company they worked with who agreed to take their clients and so we were able to still use that membership, just at a different facility. It really depends on how your contract is worded.
i would write the gym and their billing company (in one letter) and tell them that you have requested they stop charging you and to refund you for what they took after you told them to cancel. However, if you did not cancel in writing they can state you never told them to cancel. So, be sure to put it in writing immediately if you haven't done so already.
