Wow! Thank you for taking the time to answer me so quickly. This is all very helpful. It has been difficult to find the laws of Georgia on this subject. Yes my mother is speaking with the hospital staff and doctors. Its just a shame she flew to GA from CA to get him and now she has to cancel flights/change...and wait there. This is all new for us. So all info is very appreciated.
One of the treatment facilities I was in had a courtroom in the building where a judge would hear your case if they thought you needed involuntary commitment.
If they thought you needed to stay, you either stayed voluntarily or took your chances in front of the judge, who was more likely to side with them from what I hear.
In California 5150.Wow I havent heard that since my arrest in 1996.. Here in Florida they can only hold u for 72 hours also..My son was in one and on the morning of the 3rd day I was waiting to get him out..Check on the laws there.nursegirl6572 has a very good point.Please listen with an open mind when talking to them ( staff)if your only info is from him(brother).Good luck...
In most states (maybe all, not sure), when someone asks to leave a treatment facility there is a mandatory 24 hour wait, after which they have to release the patient. Hope this helps.
Your brother can leave at will. You stated he admitted himself. An involuntary commitment would involve a hearing after 72 hours, there are very strict guidelines.
Your Mom would probably have to arrange his travel back home. I would caution you to make SURE your Mom is talking directly to the rehab staff as far as info gathering versus your brother, because keep in mind that unfortunately addicts are very manipulative and will say whatever they can to get their way, especially in this kind of circumstance, where he's wanting to get out of rehab.

I don't know the law in Georgia. In CA if you are a threat to yourself you can be held in a hospital. It's called 5150 I think. Named after the code of law.
