Gitmo 9.11 Detainees to go to NY

Okay I will try not to say the bad word Terrorist ...but what do you honestly feel about them coming to a civil court in New York..to be tried the same way Americans citizensare , it seems to me that it is a way of continuing the battle against Bush and the CIA over the water boarding of 3 of them , they will of course be bringing up the torture factor . What I really dont get is why they couldnt be tried by a Miltary Court somewhere else why was this president so fast to want to shut it down what was the point he was and is still making about America ,to me it seems like he has been on a punishment quest to make us pay .....

Actually that's why I brought up the Nuremburg trials after World War II which did exactly just that, to prove that any of the various parties (that was both Japan and Gemany) who committed the atrocities during War World II were completely wrong, so there was no way it could be say America was in the wrong even though it was doubtful than anyone believed that. It was in the hopes that these kind of large scale atrocities would not occur again but that was perhaps optimistic thinking. They had actually thought of a firing squad at first but the trials were conducted not for the benefit of the emenies but to show that the war had been just and America had been in the right the whole time. The difficulty with what is going on now is that although we have technically won both wars, that is Taliban have been replaced with a democratic leadership in both Afghanistan and Iraq they are still regrouping and continue to conduct attacks and of course the war is not really over nor has their danger diminished. And certainly of concern is the fact that the trial will be conducted in the very place where 9-11 occured thus creating the potential for retalitiatory attacks. As well from what I read the judge will be picked at random. All this is very poor policy to put it lightly. A trial involving war crimes occurs after the enemy has been defeated not before. And not in a place where American lives could be at risk. I would hope that the guilty do not go unpunished and that people in N.Y.C. and Americans lives overall are not put at risk by the location and nature of these trials.

I will never forget that day, ever. As far as a civil trial, I do not agree with that. Should be a military thing and conducted by the military. Since when do our enemies get the same rights we have. War is war! I say put em in front of a firing squad and be done with it. Why spend anymore time or money on those idiots. Grrr!

I know what you mean RJ I was in Florida when it happened I watched it on TV till I was sick like you, I have been unable till the last anniversary ,that this president has called 'service day 'to watch it again , but I made myself, it still makes me feel so sick and I know you all know what I mean. the loss of human life ,yet now I here a way of protection of it, I cannot believe I am living here .The turmoil is astounding that this would happen to America...This is histroy in the making Guys ... the end of America as we have known it ... .

On the news they were talking about how if he defends himself, he will have access to all the information that the prosecutor has, which is going to include some top secret info. Meaning of course our enemy will have access on top secret information to help the terrorists. You know the case will be on television and the world will know it all. What is wrong with these people? Have they lost their minds? Obama stated to the entire Country that they will be found guilty. That taints them getting a fair trial and where can you go in the entire U.S. that there is someone that doesn't know about it? How can they even select a jury? It is impossible. The whole thing is an insult to all the families of 9-11 and to the ones that died. It is also an insult to the entire Country. The man is going to "get to tell why they did what they did".

They had one of the attorneys on tv being interviewed. He said he was "proud that he was chosen", so they would get a fair trial. He won't be in court defending them, but he is "on the team". He is proud?!!  They are going to be showing the planes running into the buildings and those that suffer the losses are going to have to re-live that, as the terrorists get to enjoy and praise their god!! The whole thing makes me want to vomit. What happens if they are found not guilty on some technical thing?? I almost think it is already in the plan. The lawyers know every trick in the book, and we can bet they already know how to reach a not guilty verdict. The terrorists are going to ride by the place of terror they caused and laugh all the way to Court because they are proud of what they did.
I will never forget what I saw. There is not enough punishment in the world to give them the justice they deserve.

And for that period of time, New York City will be unsafe. I know I will be concerned. The location was poorly planned out and does not value the safety of one of the largest cities in our country or in fact our nation as well. I do believe that it should be held in the Hague as are other international trials of this nature and besides protecting the national security the potential media circus would not be a potential problem.

Latest news is that they will plead 'not giulty' hummm this is sure going to be a circus as they said I bet there will be plenty of 'Lawyers' out there trying to get them off .....!!!

Yes I would tend to agree but we have never faced a more fanatical set of enemies. To them if they face execution they are not afraid of it and they believe they will die a martyr. I would tend to think we might reconsider some of our "allies" such as Saudi Arabia and Pakistan which have supported the fanatical ideology that caused the formation of the Taliban to begin with. I am very concerned especially about Pakistan especially as I've said because the maddrassahs directly provide training into the kind of radical fanaticism that leads young people to become a member of the Taliban. I know in a time of war things are more complex but I would not consider any country that would do that our ally and we should not provide any support politically, economically and especially military support. That would not detract from what you said.

I feel that if they try them in Civil Court, then they are only considered as criminals that committed murders v. being enemy combatants that attacked our Nation. The tax payers will fund their defense, and it is a possible chance of being thrown out for something under Civil Rights awarded Americans, that was or was not done in the procedure of arrest and they walk out free. It is down-sizing the hideous crime they committed. They committed an act of war on our own soil and took many lives. They do not deserve to be tried under the laws that are upheld for citizens of this Country. We may know they did it, but it is not a guarantee of a guilty charge. As said before, it could cause another attack in New York. It sends a message to all enemies we take what happened lightly.

A Military trial on the other hand, treats it for what it is, an attack against this Country. It makes known that they are tried for acts of war against the Nation, not a State.

Attacking the USS Cole, the first bombing of the World Trade Center were tried in Civil Courts and made no threat of consequences for an act of war to our enemies, thus 9-11.

  I believe any decisions regarding the military are made after a consultation with the secretary of defense who as I've stated is of course from the previous administration. I'm not sure who exactly was consulted for this or if the trials will ultimately be located in New York City. The decision might change after further thought. I would agree that president Obama did not deserve the Nobel Prize because that is given to a person after a life time of achievements, not during the time they are in any position in the government, let alone the presidency. I do not have much respect for Eric Holder either. In thinking back, to past war crimes tribunals were conducted in a centralized location and recent ones such as the war crimes trials of Kosovo and Bosnia were held in the Hague which is a centralized facility that is secure.
   That would indeed make more sense strategically speaking because in World War II the enemy had been already defeated and as of now considering Johnathan Walker, any person who is susectable to hatred can become inspired to take up this kind of fanaticism as their cause. I would tend to agree that it would put the people at risk for retaliatory attacks and considering that I live here I would not take that lightly. I would say that aspect of the decision was misguided to say the least and not done with the public's interest in mind. New York City has done much to safeguard our civilians from further terrorists attacks but this might open up new ground. I would think that the trial like others should be conducted in the Hague with strict military security.

The decision to bring these people to New York and try them in a criminal court represents another incomprehensible, irrational decision by Eric Holder and our esteemed Nobel-Prize winning president. Quite clearly, aside from the aspects of a criminal vs. a military tribunal, this hazards the population of this great city unnecessarily.

I believe that the idea behind it is the same as the Nuremburg trials of World War II, that is everyone knows they are guilty but this way it is proven in court so that it can't be used against us. Some of them are being tried in a military tribunal. As for people in New York City, some people are against it but some people do want them tried here for the sense of closure as they had family members killed in 9-11:

As a person living in New York City, I am personally concerned about the safety of people here and potential retaliatory attacks. However, I do believe it will be in the best interest of the United States to hold the trials out in the open. We have nothing to hide and this way it can be proven. There is the potential of one of the terrorists speaking out against the United States at the trial but that happenned at the Nuremburg trials and every word was proven wrong. I do not believe any aspect of this trial concerns how the terrorists were treated, just whether they are guilty or not and of course that can be easily proven.
