Kansas Goes Birther: State Board Considers Removing Obama From Ballot

Kansas Secretary of State Kris Kobach, an informal advisor to Republican presidential candidate Mitt Romney, said on Thursday he and his fellow members of a state board were considering removing President Barack Obama from the Kansas ballot this November.

Kobach is part of the State Objections Board along with Attorney General Derek Schmidt and Lt. Gov. Jeff Colyer, all Republicans. The Topeka Capital-Journal reported that on Thursday the board agreed consider whether to take Obama off the ballot because they said they lacked sufficient evidence about his birth certificate.

“I don’t think it’s a frivolous objection,” Kobach said, according to the Capital-Journal. “I do think the factual record could be supplemented.”

The board is looking at a complaint filed by Joe Montgomery, of Manhattan, Kan., who claimed the Obama is not a natural born U.S. citizen and so is ineligible to be president. The man appears to be part of a group of conspiracy theorists known as “birthers,” who deny Obama’s birth certificate is real.

Late Thursday, Kobach told TPM in an email conversation that he made his “frivolous objection” comment at the end of the meeting and was responding to a specific question.

“A ‘frivolous’ argument, in legal terms, is one that cannot reasonably be made under any circumstances,” Kobach wrote. “The objection passed that very low threshold, which is not saying much.”

The board will send records requests to Hawaii, Arizona and Mississippi for more documentation of Obama’s birth. They plan to meet again on Monday to discuss the matter. Arizona Secretary of State Ken Bennett questioned Obama’s birth certificate earlier this year and also briefly considered removing him from the ballot.

Obama released a copy of his long-form birth certificate in 2011, but conspiracy theories about his place of birth have endured. The certificate shows he was born in 1961 in Hawaii. His mother was a native of Kansas.

In his emails to TPM, Kobach also said more records “could easily be obtained, and should be obtained, from the relevant states before issuing any decision.” He declined to say whether he personally believes Obama in a natural born U.S. citizen, but said he might be more willing to speak on Monday “after the matter is closed.”

The Romney campaign did not immediately respond to TPM’s request for comment. Romney accepted Kobach’s endorsement in January. His campaign acknowledged in April that Kobach is an informal advisor. A major advocate of voter ID laws and measures against illegal immigrants, Kobach has also been instrumental in shepherding immigration planks into the GOP platform this year.

I can say without any hesitation that I would not vote for him if it was proved that he lied about his birthplace.

But as we BOTH said, it's basically moot, as he IS a United States citizen of natural birth.

Saying he's not, is like saying that the terrorist attacks on 9/11 were an inside job... NUTS!

First its never going to come out because he IS by birth a US Citizen. I can honestly say to you NO I would not vote for him but I would still respect him and believe in his policies if he were not a US Citizen. I STRONGLY believe that position rightfully belongs to a natural born US Citizen..That's like someone that is not a natural born citizen of China trying to become the President of China!!......UNLESS, there was a law saying otherwise, he wouldn't even be able to To be the President of the United States.

You know I'm not a "birther", MrsP.

But I have to disagree with you. At this point, it WOULDN'T matter, if it came out that BO was in fact NOT a natural born citizen. Constitutional ammendments would be proposed, people would cry "racism", there would be riots in the streets.

It's a moot point, because he WAS born in the USA, but pretend for a minute that he wasn't: He'd be reelected President, even if he WAS illegally president to begin with.

There's no way to prove that statement, but can you honestly say you WOULDN'T back the guy if it came out that he wasn't a US citizen, by birth???

Wouldn't his mother have to be in Kenya for this to happen. from what I gather Obama's Dad came to the US for school or something like that and that's how he met his mother...So did his mother fly back to Kenya with his dad when she was pregnant?? I'm mean C'mon...........

Of course it would matter EL. NO non-citizens can be president of teh United States..I mean IF this were a real issue, they would have found it to be true WEL BEFORE he was elected...Talk about letting it go....

They have been perpetuating this for the last four years for this very reason. The presidential election. Even if it reaches only a small percentage of voters, its just one more tactic to win.

*And even if he WAS born outside of the US, it wouldn't matter. All sins are forgiven as far as BO is concerned, and we'd be called "racists" for making an issue out of it. Again, this needs to be let go of, because it just doesn't matter.

In all seriousness, I'm voting for Romney and don't think the birther stuff has anything to do with him except the people who perpetuate that happen to be of the mind to do anything to get rid of Obama which helps Romney out . . . but exactly Mrs.Princince-----------  it is unbelievable that they are 'still on this'.  What a lame subject that wastes so much time.  It is embarressing to the Republian party in my opinion.
