Pathetic

One of the victims in the James Holmes mass murder spree has lawyered up and plans to file a lawsuit ... because he feels the theater dropped the ball in a very fatal way.

Torrence Brown, Jr. was in Century 16 Theater when Holmes let loose.  One of Brown's best friends, A.J. Boik, was shot in the chest and died.  Brown, who was not physically injured, claims to now suffer from extreme trauma.

Brown has hired attorney Donald Karpel to rep him.  Karpel tells TMZ ... he is targeting 3 defendants.

1.  The theater.  Karpel claims it was negligent for the theater to have an emergency door in the front that was not alarmed or guarded.  It's widely believed Holmes entered the theater with a ticket,  propped the emergency door open from inside, went to his car and returned with guns.

2.  Holmes' doctors.  Karpel says it appears Holmes was on several medications -- prescribed by one or more doctors --  at the time of the shooting and he believes the docs did not properly monitor Holmes.

3.  Warner Bros.  Karpel says "Dark Knight Rises" was particularly violent and Holmes mimicked some of the action.  The attorney says theater goers were helpless because they thought the shooter was part of the movie.  Karpel tells TMZ, "Somebody has to be responsible for the rampant violence that is shown today."

TMZ is the source.

I understand and believe that the door should have an alarm and who knows about the medication. but to sue the maker of the movie that you were there to watch is pathetic. I understand this guy is probably still in shock and greiving but don't sue the company who made the movie, they hold no responsibility.

The only way I see that the theater could be liable is if the Fire Code required an alarm on the Egress Door. I doubt it does because there has to be a Fire Marshal Inspection in order to receive an Occupancy Permit.

This is a ridiculous lawsuit.  Someone please tell me there is no hope of this going anywhere?  I mean seriously?

I don't even understand the part against the theatre or the Dr.'s.  Unalarmed emergency exit?  Do they really believe he wouldn't have found another way?  And monitoring?  The only way to monitor someone that closely is to have them committed...not a very easy thing to do.  Dr.'s prescribe, but cannot force someone to take their meds.  They are Dr.'s, not pyschic or superhuman.  And Warner Bros? What is this, the first violent movie ever produced?   Why do people insist on trying to profit from tragedy.  I just don't get it.

I did not see this coming.  Normally I do see lawsuits coming, but not this one.  It is a bit disgusting, and of course this guy is traumatized.  Everyone in the theater is to some extent!  So much so that there are probably people who will never go to a theater again.

I don't like things like this.... for lack of a better word, I too am disgusted.

I heard about this on the radio on my way into the office this morning.

I can't say I'm surprised.

Disgusted yes, but not surprised.
