Thank you very much for your informative, intellegent response! Yes I have n attourney, the best, and we have had a doctor find 9 things so far in his complete record I ordered. YES we need a doctor because the one we have will only examine the records for my attourney but he will not testify in court. The death certificate is wrong and they tried too slide it through. WE need the truth...We need one. Thank you for the referral and any info I may need on him ( email, phone,) would be greatly appreciated!!! Thanks you so much!!!! My personal email is ***@****
You have a malpractice issue. The comment that the more of the same procedures a surgeon does, the better they are at it goes for all surgeries. You expect the hospital to lie or with-hold information. Probably, to get anything, you will need a subpoena duces tecum. Actually several of them. Time is running out. You need a record of what happened in the operating room. Who was there and who did what. Were there any observers? Who were they and why were they there? Was the procedure videotaped? If so, where is the videotape? You need to know the time of day and how long the procedure lasted. Was the time exceptionally short compared to similar procedures? Has a deposition been taken from all who were present? Was the case discussed by the hospital? Cases are often discussed at the end of a week or month. Now for a review of the post-operative care. Again, who was on duty? Where are the nurses notes? What did the autopsy state? Get an opinion on the autopsy report from Dr. Michael Baden, who I know casually, and would qualify as an expert witness. Obtain the operating histories of the physician who performed the procedure. As part of the subpoena duces tecum ask exactly how many of the procedures he performed at the hospital since he was there and the dates. When you state "he did not make it" when exactly did the death take place? Who was the anesthesiologist? What anesthesia was provided? What resuscitative measures were instituted? Who did so? How long did they do so? If you are truly interested in getting to the bottom of what happened during a death you have to do this yourself and time is running out.
