You are a wonderful person to take the time to explain. again I thank you for at least giving me a heads up. You are right about a very important thing and that's if I didn't want a D.U.I. then I shouldn't have gotten behind the wheel!!!!!!!!! Also, you are very right about it being very expensive!!!!!!!!!                                       thank's again   T   ( :

*wink*

I know --- shtuff comes outta my mouth too sometimes...

No problem...

I just was spelling out what actually happens --- most people don't know -- and it is or can be very confusing for them... And scary too.

And unfortunately very expensive.

I'm sorry Rusty - I'm not prejudging you or anyone.

That is what I do for a living --- I work within the realm of  law enforcement.

I see DUI's every single day in my line of work. I know how the court systems work... And I know what generally happens in court cases - from the start with officer involvement --- to the final disposition in court...

I've personally seen too many people hurt by people who have had "just one or two beers" before they started driving - so people who do drink and drive --- even in VERY small amounts do not get any sympathy from me...

It's the one crime that NO ONE needs to commit. I believe that people who plan to drink or do end up drinking  --- and have to get somewhere else that is a distance away  need to make arrangements to get there --- PRIOR to drinking. Or they shouldn't be drinking.

People need to take responsibility for their own actions.

But I do sympathize with situations which may be out of our control.

If you had 3 beers before noon --- and then didn't have any more after noon --- then drove at 6 pm... Then you shouldn't have had alcohol in your system that would read on a breathalyzer.

Again - this is where an attorney - either your own --- or a public defender - will come into play.

Again Congrats on the not drinking part... I think that's an amazing step.

And on the no-smoking part.

I'm truly not judging you - I don't know you... What I spelled out to you are the cold hard facts.

Again - much luck to you.

Meki

Oh - there is one thing --- if you are sure that you were not intoxicated --- you COULD have the breathalyzer checked (you'll need an attorney) but if you used the breathalyzer - and that was the basis for your charge of DUI...

then you can;

A) Determine the level of training of the officer employing the breathalyzer
B) determine the level of maintenance on the machine

If it was a blood test --- then you're SOL.

Congrats on not drinking - btw --- That's an AWESOME step!

I wish I could say the same about smoking --- sniffle --- I'm a bit of a renegade in that area... LOL!

Luck - either way.

rusty - doesn't matter in any case.

Regardless of whether HCV can cause alcohol to linger in your system or your consumption levels - your breath alcohol reading or your blood test determined your alcohol rate in your body to be above the legal limits set by your state.

In a court of law - NOTHING --- not HCV or ANYTHING will change a charging document - the one sent to the District Attorney - that states you committed a crime against the state in which you reside or the incident happened.

The DA will then take the charging documents and decide whether to prosecute you or not.

Then you will have Grand Jury - which will set up a group of people who feel that you have enough preponderance of evidence of a committed  crime or not - and proceed from there. Or you will have a Judge set you - based on your state's laws and bylaws.

You can get a defense attorney or a public defender.

A good attorney may be able to ply down the charges to negligent driving if your level wasn't significantly over the legal limit and you were cooperative with the law enforcement officers.

The court room takes the stance -- if you are drinking - you shouldn't be driving ---- whether your body metabolizes the alcohol at a normal rate or not.

I can understand that you may have been just over the limit - with your concern --- so I would contact an attorney who deals specifically with DUIs.

Much luck to you.

Hey ---- just a word of caution... Next time - if you can - get a designated driver who won't drink ANY alcohol or --- grab a cab. OK?

Saves everyone a lotta money and headaches in the long run.

when I found out about this hep c. I not only quit drinking entirely but I also stopped smoking because I read that smoking ALSO effects the liver. I just was very interested in not dodging the law but at least have the law be fair with me!!!

Hey dog... I'm not much of a drinker - never have been... So it's not easy for me to answer that kind of question. I know it's bad... But I have that "HANGOVER" gene --- I've always felt like doo doo if I drank - so I've just always stayed away from heavy drinking and only partake in some very light social drinking.

But I will bet you're so very right.

Congrats on not drinking!

thank you for your comment BUT I found out after I had received a D.U.I. and the wife and I were very concerned that I didn't concume very much in a six hour period of playing pool.

i quit drinking a lot a few years ago and while going through withdrawals i found out i had hep c...i had cut down to 1 to 2 beers a day thinking that was fine and infact probably even good for me...well i was way worng ...i didn't feel good at all for a year of the couple beers a day and stopped them...that put me through withdrawals all over again...so if your not getting the right info it's easy to asume that a little drinking could be ok...and it's not..i feel much better now although i still have some sx....billy

Eh???

Uhm... let me ask you this question...

Why would someone be drinking, knowing that alcohol destroys the liver - and HCV destroys the liver?

But if your real question is to keep you from getting busted from doing a urine test --- well --- certainly if your liver is processing things slower - then logically - you could have it in your system a bit longer.

Alcohol is bad bad bad ---- especially in large amounts. I dunno if recreational drinking (social drinking ---- 1 glass of wine now and then is horrible --- but do know that excessive drinking is bad for you.)
