ssdi hearing

hey everyone I had my ssdi hearing on Thursday it was a very intense long hour of question after question finally the last question the judge asked me I cant remember what it was but I couldnt answer him i couldnt comprehend what he wanted for an asnwer and I told him that he said its ok end of hearing, he wants more records from recent pt but will render a decision in 2-3 weeks.

last night my lawyer called he said he just got off the phone with the judge he will award me %100 disability but change the onset date to sept 4th 2012 instead of 3/22/11 that is a huge loss for me 17 months no backpay and still have to wait another 5 months for a check I asked my lawyer to please ask the judge to back up onset date to at least I wount have to wait for a check I already lost my home and other stuff had to pawn my wedding rings to just get by but to wait another 5 months I will be homeless,

my options are to appeal the dedision if he doesnt back up the date that could take another 4-6 months and may not end well. or I can start from scratch new application then wait another year or so . this has been so very hard  physically and mentally exhausting I will keep you guys updated on the results lawyer will chat with judge on mon or tues please say a prayer that he will back up the date.

I am so sorry you had to endure such a tough hearing and then to have your date of disability not back-dated was so unfair. I hope your lawyer can appeal the date for you.

Your case is the exact reason I used an independent company that did ALL the work for me. They even appeared in court for me and I did not have to go in person. All for the same price as an attorney since it's set by federal law. Anyone wanting the name can contact me by PM.

So sorry Kat.  I hope your lawyer can get the back date.  Why did the judge choose 9/4/12 as the disability date?

I'm sorry that you are in such an awful situation. The 100% disability will certainly be a blessing. I truly hope your lawyer will help move things along.

Kat, this is heartbreaking.  I am happy he saw the 100% disability but hope your attorney can persuade the judge to backdate the decision.  I'll keep that thought close and hope it comes about. gentle hugs, L

Kat that is a hard decision, it's great that you got the ssdi, I hope that your lawyer has explained to you that if you "reapply" you could loose it all, even if all you are doing if challenging the onset date. Anytime you ask for part of a case to be looked at, they have the option to look at the whole case.

Do you know why he chaged the onset date, usually the date starts with the date you got the DX or the date you were no longer able to work, which ever if later.

I wish you luck in the decision you have to make, it is not an easy one. My husband went through the same thing but ended up not challenging the date. He lost 10 months of pay because of that but he didn't loose ssdi due to quality control either.

oh my gosh.  So sorry, Kat, but glad you were awarded 100%.  It could be worse.  He could have awarded nothing or less than 100%.  Now, life can move onward, but I will hope for you that your date get moved back, too.
