florida child support

Does anyone know anything about Florida child support and child custody? I can't find any solid amswers and i wanna.be prepared legally for whatever the sperm donor may or may not do.

Ok so now im.worried as hell. I wanted to try to keep it out of the courts but from what you're saying i dont think i will be able to. I actually heard it was the opposite....that if he didn't bring him.back no matter if his name is on the birth certificate or not he cant just take him and keep him from me. That would be like me leaving the state without any word to him....him not bringing my child back would be taking away my rights as his other parent. Right?

I dont really think he can take the baby from the hospital wo/ur ok. I do believe in the state of Florida, from what i heard is if the parents do not of strick guidelines on custody times/days that yes he can. I'm not a lawyer but from what i've heard that if his name is on the birth certificate he has every right to the child as you do. All i'm saying is to protect urself and the baby get the custody established and then if he dont return the child, then it will be kidnapping.

So what im.understanding from what you're saying about him signing the birth certificate is that he could just take the baby home from.thw hospital without my ok...? He could just not bring him.back to me if i let him over for the night or the day? Isnt that kidnpping? So what you're saying is that i have to file for custody of my own child? Am i understanding this correctly?

Yes if he signs it then he just as much right to the baby as u do. If he dont then he is denieing the baby and has no rights. I dont know if u work but you can always try threw united way and they can give u a number for free or low cost attorneys in ur area. I understand where u r coming from my x always told me if i left him i wouldnt get child support. Surprise....surprise...i could have wiped him clean if i wantef to being the fact he has a first degree felony child abuse against him. I didnt want child support either, i just wanted him to sign the divorce papers and he wouldnt so that pissed me off and said the hell with it and went for cs too.

Ok great...so if he signs the birth certificate what you're saying is he has just as much rights to custody as i do? That if he signs it then i have to file for custody. I live in hillsborough. So i will be talking to someone soon about the legal aspect of it. I know they do case by case. If he says that he doesnt think this is his baby and doesn't sign it then i have full and total custody right? Im.hoping we can settle outside of court but at this point its not looking like it. I dont even want to file for child supporr but i soubt i will get financial help without it....he will say im.using him lol so sad. Do u know thw web site to get the child support forms?

I dont know your situation as far as him being in the picture for the baby. If doesnt sign the birth certificate then your in the clear. But if he does and you want custody established then i would suggest to call your county clerk of courts and find out what documents u may need to get custody of the baby. After you send them to the courts they may set up a time and day for mediation. I dont know what county you are in but i live in Lee county and ut seemed like it took forever to get a date. After that is done i would also go to child support enforcement and request child support. You can get those forms online. If he agrees then then enforcement will take care if the paperwork threw the courts. If he is denieing paternity then he can ask for a test and i am not sure how long those take. But in the mean time they will retro you back child support uf it does take a while. When and if he wants visitation rights the judge could allow him to have the baby on he designated days/times. Thats if it goes to court, if you go threw mediation there will be kinda like you and him in a room with nit so much a judge but a person that works closely with a judge and allow you two to work it out and if can come to an agreemement then from there the law judge will have papers written up and that states everything agreed upon. If you can come to an agreement then they will set you up with a court date for trial. Like i said i dont know what county you are in but i know Lee county is very slow at everything. Hope this helps. If you have any nore questions feel free to ask. Oh and as far as my situation. I got custody of my children he did get partial custody but i was awarded child support that comes directally out if his check. I know of a different situation that my bf is going threw with his son but in return the mother is a dead beat and my bf was granted full custody and she is allowed visitation rights with him but its on my bf terms and has to be supervised. She is almost $30,000.00 behind in cs and refuses to get a job. So hopefully that wont be your case and will go smoothly for you.

Whats the fathers rights when in comes to visitation of a newborn? If it goes to court will the judge allow him to take the baby over night?  How long does a process like that take? Does filing for child support mean that he gets automatic visitation? Does it automatically go to court or do they try mediation first? What happened in your situation if u dont mind me asking.
