Hi Jess and all,

Chris, thank you for posting the TRUTH about the Lawyers.  I didn't have a chance to get back to it yesterday.  :{

Chris is EXACTLY correct!!  These Attorney's that take ONLY SSDI cases take NOTHING UP FRONT!!!  They take their money AFTER you get your Award for SSDI.  You are out nothig because it comesout of your BACK payments from the time that it is allowed, i.e. if you are allotted ONLY $1,000.00 in back pay, the MOST that they will get is $200.00, etc. So, it's your VERY best bet of getting your SSDI approved.  It's been proven that approximately 60% of appeals ARE WON if you have a SSDI Attorney with you at your appeal.  They WON'T accept your case UNLESS they feel that they can win it!!

Best of luck to BOTH of you, Jess AND Chris, on your appeals!!!  Hopefully, you WILL win your appeals and get the SSDI Awards that you are SO DESERVED of receiving!!!

PLEASE keep us updated as to how it oges with you!!!..........Sherry  :)

I am 44 diagnosed with RA, Fibro , depression and anxiety. I quit work last month as a toll collector which required standing and sitting for long periods as well as dealing with the elements. I applied 2 weeks ago ( just for SSD) and if I loose the first round I will definetly get as lawyer. The most they can take by law is 6,000 or 20 % of your back pay, nothing in future payments. I say let them take it, the process I hear is so much easier because he/she is doing all the work for you. Find a good one if you choose that route
Best of Luck, Chris

I also applied for SSDI but was turned down first time around.  Try and appeal, though-- it takes time, but it can be worth the effort.  If you provide thorough documentation, and have your physician(s) write a letter explaining your situation and pain in detail, you should be able to make it through.  I got SSDI after a year (but obtained SSI after only a few months) which has been so helpful, as my pain has been really terrible. I was denied first time around as well, and had to appeal, but it worked.  And thank god for medicare, which came with SSDI.....I was denied insurance repeatedly after my surgery due to my medical history (brain tumors and epilepsy), despite my need for care and post op MRIs due to possible tumor recurrance.  I am very certainly under age 50, and was able to, with much effort, obtain SSDI.  I'm sure you can too--you certianly have a case.  On a final note, try your best to do as I mentioned above before you think about going for a lawyer.  They are rather expensive.  Also, you can talk with your SS rep. on the phone, and explain your situation as well.  That can help.  Take care, and good luck.  I hope we are all able to obtain freedom from our chronic pain, and get back to living--

Hi jess,

First, I want to welcome you to the Pain Management Forum and let you know that we are glad you found this Forum. I want to let you know that there are NO Doctors on this Forum, only CP  {Chronic Pain}  Patients that help each other with our OWN expertise and experiences that we have developed through our OWN CP Issues.

I'm so sorry for ALL of this EXCRUTIATING pain that you are having to experience CONTINUOUSLY, without ANY relief, EVEN from your meds!!

I've been on SSDI - Widow's Benefit, since 2005. I will be turning 65 this July so then it's my understanding that it will turn to straight SS.  The SECRET to receiving SSDI is to be OVER 50.  This plays a HUGE part of you bing able to get it as EASILY as possible.

I need to ask you HOW LONG have you been off work?  How long have you been battling this TERRIBLE disease?  All of this will play into what is going on.

Have you hired an SSDI Attorney to HELP you FIGHT this decision?  Have you APPEALED this decision?

I was fortunate enough to have been approved the VERY FIRST time within 4 months time.  NO ONE was MORE surprised than I was.  I had NO IDEA that Severe Arthritis and DDD {Degenerative Disc Disease} were considered to be a reason for disability. I was told by DHS that I SHOULD apply as well as the Social Worker at the Hospital, after I'd had Angioplasty that I WAS DEFINITELY disabled. SO I applied and received it.   BUT at that time I was ALREADY 58 years old. {LATE 50's!! IT MAKES A HUGE DIFFERENCE!!}

NOW you need to start to fight.  If you will answer those questions that I asked then I MIGHT  be able to help you a little more as I've REALLY studied some of this since receiving mine.

Looking forward to your update...........Sherry  :)
